An Act to amend “The Timaru and Gladstone Board of Works Act 1867.”
Preamble.
WHEREAS by “The Timaru and Gladstone Board of Works Act 1867”
hereinafter called “the said Act”
a General Board of Works was established for the Electoral Districts of Timaru and Gladstone as then constituted which were for the purposes of the said Act deemed to be one entire district which was divided into certain Road Districts respectively called the Geraldine District the Levels District the Waimate District and the Mount Cook District and it was provided that the Road Board for each Road Board District and the Municipal Council now the Borough Council of Timaru should respectively annually on the first day of December in each year or on the following day if the said first day of December shall be a Sunday appoint two persons being rate-payers within their respective districts to be members of the Board And whereas it is expedient to make other provision for the election of members of the said General Board of Works
Be it therefore enacted by the General Assembly of New Zealand in Parliament assembled and by the authority of the same as follows—
1 Short Title.
The Short Title of this Act shall be “The Timaru and Gladstone Board of Works Amendment Act 1870.”
2 Sections 4 6 and 9 of “The Timaru and Gladstone Board of Works Act 1867”
repealed.
Sections four six and nine of “The Timaru and Gladstone stone Board of Works Act 1867”
are hereby repealed.
3 Road Board Districts to be called Electoral Districts.
For the purposes of the said Act and of this Act the Road Districts which at the time of the passing of the said Act were respectively called the Geraldine District the Levels District the Waimate District and the Mount Cook District and the Borough of Timaru shall from henceforth be called “The Electoral Districts under the Timaru and Gladstone Board of Works Act 1867”
and are hereinafter referred to as “the Electoral Districts.”
4 New Board how constituted.
On the first day of December next and on the first day of December in each succeeding year unless the said first day of December shall be a Sunday and then on the following day the ratepayers of each of the Electoral Districts shall elect two persons being rate-payers within the Electoral District for which they are elected to be members of the General Board for the year then next ensuing.
5 Four members to be a quorum.
Four members of the Board shall be a quorum and the Board shall be deemed to be constituted so soon as six members shall have been elected and subject as hereinafter mentioned the members of the Board shall continue in office until a new Board shall have been elected.
6 Member of the retiring Board may be appointed member of new Board.
Any member of the retiring Board may be elected a member of the new Board.
7 In case of vacancy, ratepayers of Electoral District to elect qualified person to fill vacancy.
In case any vacancy shall occur the ratepayers of the Electoral District by which he was elected shall elect another qualified person to supply the vacancy until the expiration of the year in which such vacancy shall occur.
8 Mode of conducting elections of members of Board.
All elections for members of the said Board for the several Electoral Districts other than the Borough of Timaru shall be conducted in the manner prescribed for the election of members of the Road Boards Districts within the Province of Canterbury and all elections for members of the said Board for the Electoral District of the Borough of Timaru shall be conducted in the manner prescribed for the election of Borough Councillors by any laws in force for the time being within the said Province.
9 Harbour works to include sheds landing apparatus &c.
In the twenty-first section of “The Timaru and Gladstone Board of Works Act 1867”
the term “Timaru Harbour Works”
shall be taken and construed to include all works which the Board shall deem necessary for the protection repairs or construction of any shed store landing stage or landing apparatus now erected or hereafter to be erected for the purposes of the harbour of Timaru and the words “Marine Engineer of the General Government”
shall be taken to mean such Engineer as may be approved of for the purpose of supervising such harbour works by the Colonial Secretary.
