An Act to amend “The Gisborne Land Act 1870.”
Preamble.
WHEREAS by the sixth section of “The Gisborne Land Act 1870”
it is enacted that it shall be lawful for the Governor at any time within thirty days after the passing of the said Act to cause to be published in the New Zealand Gazette a notice setting forth a short description of the lands of which under the provisions of the said Act he had issued or proposed to issue Crown grants and the name or names of the persons to whom he had made or proposed to make such grants distinguishing between lands granted or proposed to be granted to Natives in fulfilment of promises and lands proposed to be granted in fulfilment of contracts of sale and in fulfilment of contracts for exchange and also setting forth a description of the lands reserved and the purposes for which reserved And whereas no such notice as provided for by the hereinbefore recited section of the said Act hath been given and the time allowed for the giving thereof hath long since elapsed And whereas it is expedient that provision should be made authorizing the said notice to be given and that the said Act should be amended as hereinafter provided:
Be it therefore enacted by the General Assembly of New Zealand in Parliament assembled and by the authority of the same as follows:—
1 Short Title.
The Short Title of this Act shall be “The Gisborne Land Act 1870 Amendment Act 1871.”
2 Construction.
In the construction of this Act the words “the said Act”
shall mean “The Gisborne Land Act 1870”
and subject to the provisions herein contained the said Act and this Act shall be read and construed as one Act.
3 Governor may give notice under the said Act at any time.
Notwithstanding anything contained in the said Act it shall he lawful for the Governor to cause the notice referred to in the sixth section thereof to be published in the New Zealand Gazette within six months from the passing of this Act and any notice on being so published shall be deemed to be as valid and effectual to all intents and purposes as if the same had been published within the time limited by the said Act.
4 Notices &c. may be given as if the said Act had been complied with.
Upon such notice being given under the provisions of this Act every notice proclamation payment direction act matter or thing provided for in the said Act shall and may respectively be given made paid done or performed according to the provisions of the said Act as fully and effectually to all intents and purposes as if the said Act had heretofore been complied with in all respects.
5 Validation of grants and contracts.
Every grant from the Crown already made or that may hereafter be made under the authority of the said Act and every contract promise or engagement authorized to be fulfilled by the Governor thereunder shall be deemed to have been and to be valid and effectual in all respects from the date or fulfilment thereof respectively any omission in or non-compliance with the provisions of the said Act to the contrary notwithstanding:
