An Act to amend the “Wool and Oil Securities Act 1858.”
Preamble.
WHEREAS it is expedient to amend the law enabling the proprietors of sheep and whaling stations to give valid security on future produce of wool oil and bone:
Be it therefore enacted by the General Assembly of New Zealand in Parliament assembled and by the authority of the same as follows:—
1 Short Title.
The Short Title of this Act shall be “The Wool and Oil Securities Act Amendment Act 1871.”
2 Construction.
In this Act “the said Act”
shall mean the “Wool and Oil Securities Act 1858”
and this Act and the said Act shall be read and construed as one Act.
3 Provisions for giving security for further advances &c.
The provisions contained in the first and the other sections of the said Act shall from and after the passing of this Act extend and be applicable to cases where any person shall bonâ fide to for or on behalf of any proprietor of sheep or of a whaling station make give or do any of the things hereinafter mentioned (that is to say)—
(1.)
Make any present advance of money or goods to any such proprietor and agree whether absolutely or conditionally to make any future or further advances of money or goods to such proprietor.
(2.)
Give to any such proprietor or at his request make draw accept or indorse any negotiable instrument and agree whether absolutely or conditionally to renew or give make draw accept or indorse any future or other negotiable instrument.
Provided that every security made or given under this Act shall be made or given on the condition of receiving wool of the next ensuing clip or oil or bone to be caught in the next ensuing whaling season (as the case may require) and every such security shall be made and completed in accordance with the provisions of the said Act.
4 Securities deemed to be given under said Act.
Every security hereafter given under this Act shall for all purposes whatsoever be deemed to have been given under and in accordance with the said Act.
5 Form of security may be altered.
It shall be lawful for the parties to any such security to alter or vary the forms thereof given in the Schedule to the said Act with respect to the provisions or conditions to be inserted therein as circumstances may require Provided that nothing herein contained shall be construed to permit or allow of the insertion of any provisions or conditions contrary to the said Act or this Act and the said form shall in all cases be adhered to as much as possible.
