An Act to grant an Allowance out of the Consolidated Fund for the benefit of St. John Branigan Esquire late Commissioner of the Armed Constabulary in New Zealand and his Family.
Preamble.
WHEREAS St. John Branigan Esquire was a Commissioner of the New Zealand Armed Constabulary and hath become incapacitated by illness from attending to his duties And whereas it is not likely he will be able to resume his duties and it hath been proposed to grant an allowance out of the Consolidated Fund for the benefit of the said St. John Branigan and his family as hereinafter provided:
Be it therefore enacted by the General Assembly of New Zealand in Parliament assembled and by the authority of the same as follows:—
1 Short Title.
The Short Title of this Act shall be “The Branigan Allowance Act 1871.”
2 Allowance granted of £1200.
There shall be paid out of the Consolidated Fund to trustees to be appointed under this Act the sum of twelve hundred pounds to be applied for the benefit of the said St. John Branigan and his family.
3 Power to appoint trustees.
The Governor may by warrant under his hand appoint two or more fit and proper persons to be trustees for the purposes of this Act and at any time may in like manner remove any such trustee or trustees and upon the death resignation or removal of any such trustee or trustees a new trustee or new trustees may be from time to time appointed by the Governor in the like manner and upon every such new appointment the trust property shall vest without conveyance or assignment in the continuing or surviving trustee or trustees and the new trustee or trustees so appointed or in the new trustees if there be no surviving or continuing trustees upon the same trusts and with the same powers as the original trustees.
4 The allowance to be held upon such trusts as Governor approves.
The said sum of one thousand two hundred pounds shall be paid to the trustees appointed under this Act to be held upon such trusts as the Governor shall approve of and be defined in a deed to be executed by the trustees Such deed may amongst other things provide for the investment of the trust fund the payment of the annual income to or for the benefit of the said St. John Branigan during his life and after his death to or for the benefit of his widow if she survives and after the death of the said St. John Branigan and his wife for the application of the principal sum for the benefit of the children of the said St. John Branigan.
