Contents
An Act to apply a Sum of Money out of the Consolidated Fund and other Moneys to the Service of the Year ending the Thirtieth day of June One thousand eight hundred and seventy-two and to appropriate the Supplies granted in this present Session.
MOST GRACIOUS SOVEREIGN—We Your Majesty’s most dutiful and loyal subjects the House of Representatives of New Zealand in Parliament assembled towards making good the Supply which we have cheerfully granted to Your Majesty in this Session of Parliament have resolved to grant unto Your Majesty the sums hereinafter mentioned and do therefore most humbly beseech Your Majesty that it may be enacted and be it enacted by the General Assembly of New Zealand in this present Parliament assembled and by the authority of the same as follows:—
1 Short Title.
The Short Title of this Act shall be “The Appropriation Act 1871.”
2 Application of moneys.
In addition to the sum of one hundred and fifty thousand pounds (£150,000) already authorized to be applied to the service of the year ending on the thirtieth day of June one thousand eight hundred and seventy-two by “The Imprest Supply Act 1871”
there shall and may be applied out of the Consolidated Fund and out of the moneys authorized to be raised by “The Treasury Bills Act 1871”
for and towards making good the supply granted to Her Majesty a further sum of two hundred and forty-nine thousand and eighty-eight pounds five shillings and fourpence (£249,088 5s. 4d.) for the service of the said year.
3 Appropriation of supplies.
Out of all or any of the supplies or aids aforesaid there shall and may be issued and applied in addition to all other sums of money now by law permanently appropriated any sum or sums of money not exceeding in the whole the amount of three hundred and ninety-nine thousand and eighty-eight pounds five shillings and fourpence (£399,088 5s. 4d.) for or towards the several services and purposes specified and set forth in the several Classes and Votes in the First and Second Schedules hereto.
4 Confiscated land.
Out of the Land Fund of the Provinces for which the Commissioners of Crown Lands are respectively appointed there shall and may be issued and applied to defray the salaries of such Commissioners any sum or sums not exceeding the amounts specified in the First Part of the Third Schedule hereto and therein set opposite the name of the Province out of the Land Fund of which such sums are to be issued.
Expenses of Native Lands Court.
And out of the Land Fund of the several Provinces there shall and may be issued and applied to defray the salaries and expenses of the Native Lands Court specified in the Second Part of the said Third Schedule any sum or sums not exceeding in the whole four thousand six hundred and five pounds (£4,605):
Provided however that the said salaries and expenses of the Native Lands Court shall be charged against the said several Land Funds in proportion to the time during which the said Court shall have sat or shall sit in each Province during the year ending the said thirtieth day of June one thousand eight hundred and seventy-two.
Expenses of Inspector of Surveys’ Department.
And out of the said several Land Funds there shall and may be issued and applied to defray the salaries and expenses of the Inspector of Surveys’ Department specified in the Third Part of the said Third Schedule any sum or sums not exceeding in the whole three thousand six hundred and twenty-seven pounds (£3,627):
Provided that the said salaries and expenses of the said Inspector of Surveys’ Department shall be charged against the Land Funds of the several Provinces in proportion to the number of acres in each Province surveyed by such Department during the said year.
5 Trust Fund.
Out of the moneys standing to the credit of the several separate accounts in the Public Trust Fund specified in the Fourth Schedule hereto there shall and may be issued and applied the several sums specified in the said Schedule and such sums shall be issued out of the respective accounts against which the same are charged in the Schedule.
6 Defence Loan.
Out of any of the moneys authorized to be raised under “The Defence and Other Purposes Loan Act 1870”
there shall and may be issued and applied any sum or sums of money not exceeding in the whole one hundred and sixty thousand pounds (£160,000) for or towards the costs charges and expenses of the services and purposes specified and set forth in the Fifth Schedule hereto.
7 Salaries of Commissioners of Crown Lands.
Out of such portion of the Special Fund as may have arisen or may hereafter arise from the proceeds of the sale or other disposal of lands taken under “The New Zealand Settlements Act 1863”
or any Acts amending the same there shall and may be issued and applied any sum or sums not exceeding in the whole six thousand three hundred and seventy pounds eleven shillings (£6,370 11s.) for and towards the services and purposes specified in the Sixth Schedule hereto and out of the said portion of the Special Fund there may also he issued and applied the sum of six thousand and sixty-one pounds three shillings and fivepence (£6,061 3s. 5d.) for the purpose of repaying to the Consolidated Fund the moneys issued therefrom in respect of the services specified in the Third. Part of the Eighth Schedule hereto.
8 Public Works.
Out of any of the moneys for the time being standing to the credit of the Public Works Account there shall and may be issued and applied any sum or sums not exceeding in the whole sixty-one thousand nine hundred and sixty-nine pounds fourteen shillings and tenpence (£61,969 14s. 10d.) for or towards the costs charges and expenses of the services and purposes specified in the Seventh Schedule hereto.
9 Indemnity for unauthorized expenditure set forth in Third Schedule.
And whereas the actual expenditure of the General Government for the year ending on the thirtieth day of June one thousand eight hundred and seventy exceeded the sum authorized by law by the sum of nine hundred and nine pounds seven shillings and one penny (£909 7s. 1d.) in respect of the services specified in the First Part of the Eighth Schedule hereto And whereas the actual expenditure for the year ending the thirtieth day of June one thousand eight hundred and seventy-one exceeded the sum authorized by law by the sum of twenty-seven thousand three hundred and sixty-seven pounds ten shillings and tenpence (£27,367 10s. 10d.) in respect of the services specified in the Second Part of the said Eighth Schedule hereto and six thousand and sixty-one pounds three shillings and fivepence (£6,061 3s. 5d.) in respect of the services specified in the Third Part of the said Eighth Schedule and sixty-one pounds fourteen shillings (£61 14s.) in respect of the services specified in the Fourth Part of the said Eighth Schedule hereto and whereas the said expenditure in excess was reasonable and necessary Be it therefore enacted the several Colonial Treasurers and all persons whatsoever are hereby indemnified for the expenditure of the sums in this section hereinbefore mentioned and the Colonial Treasurer shall receive credit in his account for the said sums accordingly.
10 Repayment to Consolidated Fund from Auckland Land Fund of expenses.
Out of the Land Fund of the Province of Auckland there may be issued and applied the sum of sixty-one pounds fourteen shillings (£61 14s.) for the purposes of repaying to the Consolidated Fund the moneys issued therefrom in respect of the services specified in the Fourth Part of the Eighth Schedule hereto.
11 Treasurer to issue moneys on warrant of Governor.
The Treasurer of New Zealand shall issue and pay the said several sums hereby appropriated to such person for the purposes hereinbefore mentioned upon such days and in such proportions as the Governor may by any warrant to be signed by him order and direct and the payment so to be made shall be charged upon and payable out of such supplies and aids as aforesaid.
12 Treasurer allowed credit for moneys issued in pursuance of warrant.
The said Treasurer shall in his accounts from time to time be allowed credit for any sum of money paid by him in pursuance of any warrant issued by virtue of this Act and the receipt of the person to whom the same shall be so paid shall be a full and valid discharge to the said Treasurer in passing his said accounts for any such sum as shall be therein mentioned.
