An Act to authorize the Grant and Conveyance of certain Pieces of Land to the Oamaru Dock Trust.
Preamble.
WHEREAS the piece of land described in the First Schedule hereto was, with other land, granted to the Superintendent of Otago, on the eleventh day of May last, for purposes of public utility for the Town of Oamaru and its inhabitants: And whereas by an Ordinance of the Legislature of the said Province, shortly intituled “The Oamaru Dock Trust Ordinance, 1869,”
a corporate body, styled the “Oamaru Dock Trust,”
was constituted for the purpose of the construction repairs making and management of a Dock at Oamaru, and for certain other purposes in the said Ordinance mentioned: And whereas the Legislature of the said Province, in the last Session thereof, passed a Bill intituled “The Oamaru Town Reserves Management Ordinance, 1872,”
for the purpose of authorizing the Superintendent of the said Province to vest the management of certain lands described in the Schedule thereto in the Corporation of the Incorporated Town of Oamaru: And whereas the piece of land described in the Schedule hereto was by mistake included in the Schedule to the said Bill: And whereas the two pieces of land described in the Second Schedule hereto are now part of the highways in the said Town of Oamaru, but are not required for the purpose: And whereas it is expedient the pieces of land described in the First and Second Schedules hereto should be vested in the said Oamaru Dock Trust, upon the like terms and purposes upon and for which the lands described in the Oamaru Dock Trust Ordinance are held by the said Oamaru Dock Trust:
Be it therefore enacted by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
The Short Title of this Act shall be “The Oamaru Dock Trust Land Act, 1872.”
2 The Bill recited not to have operation as to lands in Schedules.
The Bill in the preamble hereof mentioned shall, if and when assented to by the Governor, have and be deemed to have had no force or operation with regard to the lands described in the Schedules hereto.
3 Superintendent of Otago to convey to Oamaru Dock Trust land in First Schedule.
Notwithstanding anything to the contrary contained in the said “Oamaru Town Reserves Management Ordinance, 1872,”
the Superintendent of the said Province shall, with all convenient despatch, convey the piece of land described in the First Schedule hereto to the said Oamaru Dock Trust.
4 Lands in Second Schedule to cease to be highways, and to be granted to said Trust.
The pieces of land described in the Second Schedule hereto shall, on the passing of this Act, cease to be public highways, and the Governor may grant the same in fee-simple to the said Oamaru Dock Trust.
5 The said Trust to hold the lands on same trust as other lands.
The lands described in the Schedules hereto, when conveyed or granted, as the case may be, to the said Oamaru Dock Trust, shall be held in trust by it, and be subject to the provisions of the said Oamaru Dock Trust Ordinance, as if included in the description contained in the Schedule to the said Ordinance: Provided that nothing herein contained shall authorize the sale or leasing of the said lands.
SCHEDULES
FIRST SCHEDULE
All that parcel of land, containing about 12 acres 1 rood 37 perches, being that part of Reserve A, in the Town of Oamaru, lying between the Beach Reserve and that part of a line intersecting the said Reserve A, drawn from the north-eastern corner of Test Street to a point on the north-western boundary of the Lighthouse Reserve, 800 links from the northern corner of the last-mentioned reserve.
SECOND SCHEDULE
All that part of the road between Reserve A and the Lighthouse Reserve, in the Town of Oamaru, containing about 3 roods 8 perches, which lies to the northward of a line drawn from a point on the north-western boundary of the Lighthouse Reserve, 800 links from the northern corner of the last-mentioned reserve towards the north-eastern corner of Test Street.
All that part of the street bounding Reserve A, Town of Oamaru, on the Northwest, containing about 1 rood 3 perches, which lies to the northward of a line drawn from the north-east corner of Test Street to a point on the north-western boundary of the Lighthouse Reserve, 800 links from the northern corner of the last-mentioned reserve.
