An Act to amend “The Lands Clauses Consolidation Act Amendment Act, 1866.”
BE IT ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
The Short Title of this Act shall be “The Lands Clauses Consolidation Act Amendment Act, 1872.”
2 “Or”
substituted for “and”
in the third line of section 5 of “The Lands Clauses Consolidation Act Amendment Act 1866.”
The word “or”
shall be substituted in lieu of the word “and”
where the same occurs in the fifth section of “The Lands Clauses Consolidation Act Amendment Act, 1866,”
immediately after the word “incapacity”
and before the words “not having power;”
and the said Act shall be construed and read as if the word “or”
had been so substituted on the first passing of the said Act.
3 Costs of arbitrations may be taxed.
Where under “The Lands Clauses Consolidation Act, 1863,”
or any Act amending or incorporating the same, any question of disputed compensation is determined by arbitration, in the manner provided by the said “Lands Clauses Consolidation Act, 1863,”
the costs of and incidental to such arbitration and award shall, if either party so requires, be taxed and settled as between the parties by the Registrar, or if there be no Registrar by the Deputy Registrar of the Supreme Court appointed to act in the Province in which the arbitration is conducted; and such fees may be taken in respect of the taxation as may for the time being be demanded and taken by Registrars in other cases of taxation of costs of arbitration.
