An Act to amend the Bishop of New Zealand’s Trusts Acts, 1858 and 1868, and “The Religious Charitable and Educational Trusts Act Amendment Act, 1865.”
Preamble.
WHEREAS by “The Bishop of New Zealand’s Trusts Act, 1858,”
and by “The Bishop of New Zealand’s Trusts Act, 1868,”
the Bishop of New Zealand was empowered to convey all and singular the allotments or parcels of land held by him in trust for religious educational charitable or other purposes to Trustees to be appointed by the General Synod of the Branch of the United Church of England and Ireland in New Zealand: And whereas by the said recited Act power is given to the Trustees of any such land to lease the same for any term not exceeding twenty-one years: And whereas by “The Religious Charitable and Educational Trusts Act Amendment Act, 1865,”
the like power of leasing is given to the Trustees of land held in trust for any Diocesan Synod: And whereas the said General Synod is desirous that for budding purposes all such Trustees as aforesaid should be empowered to grant leases for any term not exceeding sixty years:
Be it therefore enacted by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
The Short Title of this Act shall be “The Church of England Lands Buildings Leases Act, 1872.”
2 Repeal.
“The Church Lands Building Leases Act, 1871,”
is hereby repealed.
3 Power to lease.
It shall be lawful for the Trustees of any such lands as aforesaid, in respect of which no trust shall have been created inconsistent with the present power to lease the same, or any part thereof, for building purposes, for any term not exceeding sixty years, on such terms and subject to such conditions as the Synod of the Diocese in which such lands are situate shall from time to time prescribe.
4 Delegation of powers.
The powers to be exercised under the preceding section by the Synod of each Diocese may be delegated by such Synod to the Standing Committee of the Diocese.
