The Short Title of this Act shall be “The Weights and Measures Act Amendment Act, 1873.”

So much of the nineteenth section of the said Act as provides that there shall be paid to every Inspector who may be appointed under the said Act such salary and such sums of money by way of travelling expenses during his tenure of office as the Governor may direct, to be paid out of any moneys to be appropriated for the purpose by the General Assembly, is hereby repealed, and in lieu thereof it is enacted as follows:—

There shall be paid to every Inspector who may have been or shall hereafter be so appointed as in the said Act provided, such salary and such sums of money by way of travelling expenses during his tenure of office as such Inspector as the Superintendent of the Province within which such Inspector is appointed to act may direct; and such sums shall be paid out of any moneys to be appropriated for the purpose by the Provincial Legislature of such Province.

All penalties and proceeds of forfeitures under the said Act shall, in lieu of being paid as provided by the fiftieth section of the said Act, be revenue of the Province or County within which the offence in respect of which such penalties and forfeitures shall have been recovered or enforced shall have been committed; and the fees payable to Inspectors, in lieu of being accounted for as in the said fiftieth section of the said Act provided, shall be revenue of the Province or County within which the Inspector to whom the same are paid is appointed to act; and all such penalties proceeds and fines shall be paid to the Provincial Account of such Province.

Nothing in this Act shall affect any penalties or other forfeitures recovered or to be recovered in respect of any offence committed before the passing of this Act.

The power of appointing Inspectors of Weights and Measures, and of removing such Inspectors from office, vested in the Governor by the nineteenth section of the said Act, is hereby vested in the Superintendent of the Province for or within which any such Inspector shall have been appointed, and such powers shall and may be exercised by such Superintendent, with the advice and consent of his Executive Council, from time to time as occasion shall require: Provided that every Inspector holding office under the said Act shall continue to hold such office until resignation or removal from office, as by the said Act is provided.
