An Act to repeal the Grant to the Superintendent of the Province of Auckland of the Land described in the Schedule, and to empower the Governor to issue another Grant in lieu thereof.

Preamble.

WHEREAS some time since the land described in the Schedule was purchased by the Provincial Government of the Province of Auckland from the Colonial Government with funds exclusively belonging to the Province, and a grant of the said land was to have been issued to the Superintendent of the said Province and his successors for Provincial purposes: And whereas by the grant which was subsequently issued for the said land, dated the nineteenth day of November, one thousand eight hundred and sixty-four, and which is set forth in the Schedule hereto, the said land was erroneously granted to the said Superintendent “in trust as an endowment for the improvement and benefit of the City of Auckland,” and it is right and necessary that the error thus made should be rectified, and that the said land should be vested as originally intended:

Be it therefore enacted by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—

1 Short Title.

The Short Title of this Act shall be “The Auckland Supreme Court Site Act, 1873.”

2 Former grant repealed.

The said grant set forth in the Schedule is hereby repealed.

3 New grant to be issued.

It shall be lawful for the Governor to grant the said land to the Superintendent of the Province of Auckland and his successors in office, in trust for such uses intents and purposes as may from time to time be declared and enacted in that behalf by any Act or Acts of the Superintendent and Provincial Council of the said Province.

Schedule

Victoria, by the grace of God of the United Kingdom of Great Britain and Ireland, Queen:

To all to whom these presents shall come, greeting:

Know ye that, for good considerations us thereunto moving, we, for us our heirs and successors, do hereby grant to the Superintendent of the Province of Auckland and his successors, Superintendents of the said Province, all that parcel of land in the Province of Auckland, in our Colony of New Zealand, situate in the City of Auckland, and being allotments numbered one (1), two (2), three (3), and four (4) of section numbered fifteen (15) of the said City of Auckland, containing by admeasurement one (1) acre and twenty (20) perches, more or less. Bounded towards the North by Victoria Street, three hundred and twenty-eight (328) links; towards the East by Queen Street, three hundred and forty-four (344) links; towards the South by Allotment No. 5, three hundred and twenty-eight (328) links; and towards the West by Elliott Street, three hundred and forty-four (344) links. As the same is delineated on the plan in the margin hereof, with all the rights and appurtenances thereto belonging, to hold unto the said Superintendent of the Province of Auckland and his successors, in trust as an endowment for the improvement and benefit of the City of Auckland.

In testimony whereof we have caused this our grant to be sealed with the Seal of the Colony of New Zealand.

Witness our trusty and well-beloved Sir George Grey, K.C.B., Governor and Commander-in-Chief in and over the Colony of New Zealand, at Auckland, this nineteenth day of November, in the twenty-eighth year of our reign, and in the year of our Lord one thousand eight hundred and sixty-four.
