An Act to amend “The Justices of the Peace Act, 1866.”
Preamble.
WHEREAS by “The Justices of the Peace Act, 1866,”
(hereafter referred to as “the said Act,”
) provision is, amongst other things, made for dealing summarily with certain charges of larceny; and whereas it is expedient to extend the said provisions of the said Act to certain other crimes:
Be it therefore enacted by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
The Short Title of this Act shall be “The Justices of the Peace Act Amendment Act, 1874.”
2 Interpretation of larceny, as used in sections from 82 to 86 in “The Justices of the Peace Act, 1866.”
The provisions contained in the sections of the said Act numbered from eighty-two to eighty-six both inclusive, shall, so far as applicable, extend and apply to larceny by a bailee, anything in the third section of “The Larceny Act, 1867,”
to the contrary notwithstanding, and to all felonies which by “The Larceny Act, 1867,”
are made punishable like simple larceny, and to the felonies and misdemeanours mentioned in the second column of the Schedule hereto, and to all other felonies and misdemeanours mentioned described or provided for in the sections of “The Larceny Act, 1867,”
specified in the first Column of the said Schedule hereto.
In applying the provisions of the said Act, the word “stolen”
shall include “embezzled”
and “obtained by false pretences,”
as the case may require.
Section eighty-two of the said Act shall apply only where the value of the property stolen embezzled or obtained by false pretences does not exceed twenty shillings.
Section eighty-three of the said Act shall apply only where the value of the property stolen embezzled or obtained by false pretences does not exceed five pounds.
Section eighty-four of the said Act shall apply only where the value of the property stolen embezzled or obtained by false pretences does not exceed ten pounds.
