An Act to amend “The Harbour Boards Act, 1870.”

Preamble.

WHEREAS by the fourteenth section of “The Harbour Boards Act, 1870,” (hereafter referred to as “the said Act,”) it is enacted that all fees fines dues charges rents and other moneys whatsoever, which shall be paid to or leviable or received by any such Harbour Board as in the said Act referred to, shall be applicable and applied by such Board towards the payment of all expenses properly or necessarily incurred in carrying the said Act into execution, and of doing and performing all acts and things which such Board is or shall be by the said Act empowered or required to do or perform:

And whereas doubts are entertained whether it is competent for Provincial Legislatures to authorize Harbour Boards constituted under Ordinances of such Legislatures passed in pursuance of the said Act to apply the moneys mentioned in the said fourteenth section to purposes other than those therein specified, and it is expedient that such doubts should be removed:

Be it therefore enacted by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—

1 Short Title.

The Short Title of this Act shall be “The Harbour Boards Act Amendment Act, 1874;” and this Act shall be read and construed as part of the said Act.

2 Provincial Councils declared to have had power to authorize application of funds of Boards to purposes to be specified.

Notwithstanding anything to the contrary in the said fourteenth section of the said Act, the Provincial Legislature of every province shall have, and ever since the passing of the said Act be deemed to have had, full power to authorize the application of the funds of any Harbour Board constituted in pursuance of the said Act within such province, from whatever source arising, to any such purposes as have been or shall be authorized by any Ordinance of the Legislature of the province within which the Board is established, for or in furtherance of the objects and purposes for which the Board is established, and such funds shall be applicable accordingly, not only to the purposes specified in the fourteenth section of the said Act, but also to any such purposes as aforesaid as have been or shall be authorized by such Legislature, unless expressly otherwise provided by any Act of the General Assembly now in force or hereafter to be passed.
