An Act to reserve Land as an Endowment for a Harbour Board to be constituted for the Harbour of Napier.

BE IT ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—

1 Short Title.

The Short Title of this Act shall be “The Napier Harbour Board Act, 1874.”

2 Lands in Schedule set aside for use benefit and endowment of Harbour Board of Napier Harbour.

The lands described in the Schedule hereto are hereby reserved and set aside for the use benefit and endowment of such Harbour Board as shall hereafter be constituted for the Harbour of Napier, in the Province of Hawke’s Bay, under an Act of the Legislature of the said province, to be passed in pursuance of “The Harbour Board Act, 1870,” and upon the constitution of such Board shall vest therein without any conveyance, upon the trusts and for the purposes aforesaid.

3 Lands to be vested in Superintendent, subject to be dealt with under “The Public Reserves Act, 1854,” and “The Harbour Boards Act, 1870.”

Such of the said lands as before the passing of this Act shall have been granted by the Crown and shall have been vested in the Superintendent of the said Province, whether subject to any trusts or for any purposes or not, shall, on the passing of this Act, be held by him upon the trusts and for the purposes mentioned in the second section hereof; and such of the said lands as shall not before the passing of this Act have been granted by the Crown, shall, on the passing of this Act, be granted to the Superintendent of the said province, upon the trusts and for the purposes mentioned in the second section of this Act: Provided however that all the lands described in the said Schedule shall be deemed to be reserves within the meaning of and subject to be dealt with under “The Public Reserves Act, 1854,” and any Act amending the same, and “The Harbour Boards Act, 1870,” and any Act amending the same; but the purposes for which such reserves are hereby made shall not be alterable by the provincial Council of the said Province.

Schedule

1.

All that parcel of land in the Province of Hawke’s Bay, in the Colony of New Zealand, situate in the Town of Napier, containing by admeasurement 13 acres and 2 roods, more or less, bounded towards the North-east by the Suburban Section No. 46, 1048 links; towards the South-east by Suburban Sections Nos. 47 and 48, by the termination of the Burns Road, and by Suburban Section No. 24,1300 links; towards the South-west by Suburban Section No. 23, 1016 links; and towards the North-west by the Chaucer Road, 150 links, and 40 links; and by the Battery Road, 1150 links.

All that parcel of land in the aforesaid Province of Hawke’s Bay, situate in the Town of Napier, containing by admeasurement 1 rood and 16 perches, more or less, bounded towards the North-east by Section No. 499, 120 links; towards the East and South by the harbour; and towards the North-west by Section No. 500 and by public road, 210 links.

All that parcel of land in the aforesaid Province of Hawke’s Bay, situate in the Town of Napier, containing by admeasurement 1 rood and 16 perches, more or less, bounded towards the North-west, North, and East by the Harbour; towards the Southeast by Colin Street, 140 links; and towards the South-west by Section No. 523, 230 links.

All that parcel of land in the aforesaid Province of Hawke’s Bay, situate in the Town of Napier, containing by admeasurement 1 rood and 33 perches, more or less, bounded towards the North by North Terrace, 400 links; towards the East by Nott Street, 230 links; and towards the South-west by Charles Street, 450 links.

All that parcel of land in the aforesaid Province of Hawke’s Bay, situate in the Town of Napier, containing by admeasurement 2 roods, more or less, bounded towards the North by North Terrace, 80 links, and a curvilineal line; towards the East by Tareha Street, 200 links; towards the South by Charles Street, 230 links; and towards the West by Section No. 50, 250 links.

All that parcel of land in the aforesaid Province of Hawke’s Bay, situate in the Town of Napier, containing by admeasurement 37 perches, more or less, bounded towards the North by North Terrace, 220 links; towards the East by a public street, 85 links; towards the South by Charles Street, 200 links; and towards the West by Tareha Street, 150 links.

All that parcel of land in the aforesaid Province of Hawke’s Bay, situate in the Town of Napier, containing by admeasurement 1 rood, more or less, bounded towards the North by Section No. 29, 75 links; towards the East by James Street, 250 links; towards the South by Meanee Quay, 155 links; and towards the West by Section No. 22, 228 links.

All that parcel of land in the aforesaid Province of Hawke’s Bay, situate in the Town of Napier, containing by admeasurement 1 acre and 2 roods, more or less, bounded towards the North-east and South by Hawke’s Bay and the harbour respectively; and towards the South-west by Charles Street and Meeanee Quay, 590 links.

All that parcel of land in the aforesaid Province of Hawke’s Bay, situate in the Town of Napier, containing by admeasurement 18 perches, more or less, bounded towards the North-east by Charles Street, 220 links; towards the South-east by Meeanee Quay, 130 links; and towards the South-west by Section No. 1,165 links.

All that parcel of land in the aforesaid Province of Hawke’s Bay, situate in the Town of Napier, containing by admeasurement 20 perches, more or less, bounded towards the North by Charles Street, 240 links; towards the South-east by Sections Nos. 1, 2, and 3, 200 links; and towards the South-west by Section No. 13,130 links.

11.

All that parcel of land in the aforesaid Province of Hawke’s Bay, situate in the Town of Napier, containing by admeasurement 1 acre and 2 roods, more or less, bounded towards the North-east and East by Meeanee Quay, 425 links and 150 links respectively; towards the South by the harbour; and towards the West by the harbour and a Native reserve, 350 links.

Port Ahuriri Lagoon.

12.

Containing 74 acres, more or less, situate in the Town of Napier, commencing at Battery Point, at the junction of Battery Road with the railway line; following a straight line to the southernmost corner of Section 537; along the south-eastern boundary of that section to its easternmost corner; thence in a straight line to the southernmost corner of Section 491; following along the south-east boundary of Sections 491, 489, and 487, and along the southern boundary of Sections 485, 483, and 481, to the eastern corner of the last-named section; thence along its north-east boundary to Waghorn Street; following along the southern side of Waghorn Street, and along the southern boundary of Sections 468, 467, and 466; thence along the eastern boundary of the last-named section to Waghorn Street; crossing that street and following along the edge of the’ Ahuriri Lagoon to Battery Road; and from thence following along the north-west side of Battery Road to the starting point at the junction of Battery Road with the railway line.

Te Whare-o-Maraenui Block

13.

Containing 1784 acres and 2 roods, more or less, situate in the Napier Suburban District; commencing at the mouth of the Tutaekuri River, on the east bank; following a line bearing 234 degrees 57 minutes to Wellesley Road; following along the southern side of that road, and along the western boundary of the Tutae-o-mahu Block to Tareha’s Bridge; thence along the north side of said bridge, and along the east and north boundaries of the Pukeroa Block to the Meeanee Road; following along that road a distance of 2234 links to a public road, and along the north side of said public road to the Tutaekuri River; down that river to Tareha’s Reserve; following round the south-east and north boundaries of that reserve again to the Tutaekuri River, and down that river to the starting point at its mouth.

Ahuriri Lagoon—7,900 Acres

14.

Commencing at the mouth of the Ahuriri Harbour, on the inner beach of the Western Spit, following northerly along the shore of the Ahuriri Lake to the mouth of the River Esk; thence continuing westerly and southerly along the shore of the Ahuriri Lake, along the northern and eastern side of Park’s Island, and again by the southern shore of the Ahuriri Lake to the mouth of the Tutaekuri River; thence following along the north-west boundary of the Te Whare-o-Maraenui Block to the railway line; thence following northerly along the railway line to northern end of the new breastwork, and from thence crossing the entrance of the Ahuriri Harbour in a straight line to the commencing point on the inner beach of the Western Spit; excluding the islands called Roro-o-Kuri, Para-Para, Te Ihuotekei, Uruwiri, Poro-Poro, Tirowhangahe, Tuteranuku, Awa-a-waka, and Matawhero.
