An Act to complete certain Exchanges of Land in New Plymouth.
Preamble.
WHEREAS under the provisions of “The New Plymouth Exchanges Commission Act, 1865,”
“The New Plymouth Exchanges Commission Act Amendment Act, 1866,”
and “The New Plymouth Exchanges Commission Amendment Act Amendment Act, 1867,”
(hereinafter called “the said Act,”
) certain exchanges of land in the Town of New Plymouth have been certified to by the Commissioners appointed pursuant to the first recited Act: And whereas it is by the last recited Act enacted that every such certificate shall, for the purpose of completing the exchange so agreed or arranged, vest and be taken to vest in the person therein certified to be the owner of the land therein certified to be the property of such person, for an estate of inheritance in fee-simple, subject to a contract to exchange such land with the Superintendent of Taranaki for such other land, being part of the public reserves of the Town of New Plymouth, or land by such exchanges as aforesaid arranged to be taken for the same, as shall also be described in such certificate: And whereas under the authority of and in accordance with the said Acts, or some or one of them, certificates have been granted to the persons named in the second column of the Schedule hereto, and such persons have exchanged the parcels of land mentioned in the first column of the said Schedule for the parcels of land mentioned in the third column thereof, and it is expedient that means should be provided for completing titles to the lands which have been, dealt with under the said Acts:
Be it therefore enacted by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
The Short Title of this Act shall be “The New Plymouth Exchanges Completion Act, 1874.”
2 Lands in first column of Schedule to vest in the Superintendent.
The several sections and parcels of land within the original town of New Plymouth, the numbers or other distinguishing marks of which upon the plan of the said town are set forth in the first column of the Schedule hereto, shall be and the same are hereby vested in the Superintendent of the Province of Taranaki as fully and effectually as if conveyances thereof respectively had been made to him, and the same shall be held by the said Superintendent and his successors in office as public reserves, and shall be held by him upon and subject to the like trusts and for like purposes as the said sections and parcels of land for which the same have been exchanged as aforesaid were heretofore held by such Superintendent; and, subject to this Act, such reserves shall be liable to be dealt with sold leased managed or disposed of in the same manner and to the same extent as if the same had been granted to the said Superintendent under “The Public Reserves Act, 1854,”
or any Act amending the same.
3 Lands in third column of Schedule to vest in persons named in second column.
The several sections and parcels of land within the original town of New Plymouth, the numbers or other distinguishing marks of which are set forth in the third column of the said Schedule, shall be and the same are hereby vested in the several persons whose names are set forth in the second column of the said Schedule, opposite to such numbers or other distinguishing marks as aforesaid, and their heirs and assigns, for an estate of inheritance in fee-simple as fully and effectually as if conveyances were executed to the said persons their heirs and assigns.
4 Before Act takes effect, Crown grants to be obtained by persons entitled.
Before the two last preceding sections of this Act shall take effect, the person or persons legally entitled to the lands mentioned in the first column of the said Schedule shall obtain and take up a grant or grants from the Crown for the lands exchanged with the said Superintendent under the authority of the said Acts and this Act, and such grants shall be by such persons delivered up to the Superintendent.
5 Definition of “original town of New Plymouth.”
For the purposes of the said Acts and of this Act, the expression “original town of New Plymouth”
shall mean the town of New Plymouth as originally laid out by the Plymouth Company, and delineated on the map thereof deposited in the survey office of New Plymouth.
6 Maps to be recorded, and Registrar to make entries.
Maps indicating the several exchanges of land certified to by the Commissioners, together with the Schedules to this Act, shall be recorded in the Register Office in New Plymouth, and the Registrar of Deeds shall thereupon make such entries in the register books as shall accord with the said Schedules.
