An Act to declare the Powers of the Kakanui Harbour Board.
Preamble.
WHEREAS an Ordinance was passed by the Provincial Council of Otago, in the thirty-second session thereof, shortly intituled “The Kakanui Harbour Board Ordinance, 1873,”
(hereinafter referred to as “the said Ordinance”
): And whereas the said Ordinance received the Governor’s assent on the sixth day of October, one thousand eight hundred and seventy-three: And whereas the Harbour of Kakanui had not then been defined as a port under “The Marine Act, 1867,”
but such harbour has by Warrant published in the New Zealand Gazette, number thirty-seven, of date first July, one thousand eight hundred and seventy-five, been so defined: And whereas it is expedient that the powers of the Kakanui Harbour Board under the said Ordinance should be declared as hereinafter provided:
Be it therefore enacted by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
The Short Title of this Act shall be “The Kakanui Harbour Board Act, 1875.”
2 Declaration as to powers of Board
From and after the passing of this Act the Kakanui Harbour Board shall have and may exercise all the powers and authorities by the said Ordinance conferred, and shall be subject to all the provisions and conditions in the said Ordinance contained, and such Ordinance shall apply to the said Port of Kakanui so defined as aforesaid, and shall be deemed so to apply as effectually as if such port had been duly defined at the date when the said Ordinance was assented to as aforesaid.
