An Act to amend “The Wellington Reclaimed Land Act, 1871.”
Preamble.
WHEREAS by section numbered seven of “The Wellington Reclaimed Land Act, 1871,”
it was enacted that the Mayor, Councillors, and Citizens of the City of Wellington (therein and hereinafter called “the Corporation aforesaid”
), and their successors might, from time to time, at their discretion, sell all or any part or parts of the land described in the First Schedule to the said Act, for such price or prices in money as they should, with the previous sanction of the Governor in Council, determine; and upon payment of the purchase money for the same, as thereinafter mentioned, the Governor or his successors should join in the conveyance of the same to the purchaser or purchasers: And whereas the Corporation aforesaid are desirous of exchanging the land described in the First Schedule to this Act for the land described in the Second Schedule, receiving by way of owelty of exchange the sum of four thousand pounds, and it is expedient to empower them to make such exchange:
Be it therefore enacted by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
The Short Title of this Act shall be “The Wellington Reclaimed Land Act, 1875.”
2 Act to be read as part of Act of 1871.
This Act shall be read as part of “The Wellington Reclaimed Land Act, 1871.”
3 Corporation may exchange land.
The Corporation aforesaid may exchange the land described in the First Schedule to this Act for the land described in the Second Schedule thereto, and may, upon such exchange, receive the sum of four thousand pounds by way of owelty of exchange; but the amount to be paid by way of owelty of exchange shall be deemed, for the purposes of the said Act, to be moneys within the meaning of the ninth section of the said Act payable in respect of the purchase of the land described in the First Schedule to this Act.
4 Land taken in exchange to be subject to Act of 1871.
The land described in the Second Schedule to this Act shall, immediately after the completion of the exchange authorized by this Act, be treated as if the same had formed part of the land described in the First Schedule to the said Act, and be subject to the provisions of the said Act so far as the same relate to the land described in the said First Schedule thereto.
SCHEDULES
FIRST SCHEDULE
All that piece or parcel of land being part of the Reclaimed Land comprised in the First Schedule to “The Wellington Reclaimed Land Act, 1871,”
as land set out on the plan thereof; bounded on the North by Waring Taylor Street, one hundred and ninety-six (196) feet ten (10) inches; on the East by Custom House Quay, one hundred and seventy (170) feet; on the South by Johnston Street, one hundred and ninety-six (196) feet ten (10) inches; and on the West by Featherston Street, one hundred and seventy (170) feet; be the same dimensions little more or less.
SECOND SCHEDULE
All that piece of land being the Sections numbered 84, 85, 86, 87, and parts of Sections numbered 88 and 137, on the plan of the Reclaimed Land in the said city; bounded on the North by Brandon Street, seventy-eight (78) feet six (6) inches; on the South by Panama Street, seventy-eight (78) feet six (6) inches: on the East by other parts of the said Sections numbered 88 and 137, now in the occupation of the Provincial Government of Wellington, one hundred and seventy (170) feet; and on the West by Featherston Street, one hundred and seventy (170) feet; be the same dimensions a little more or less.
