An Act to qualify Persons living in Lodgings to vote at the Election of Members of the House of Representatives, and to enable such persons to be registered on the Electoral Roll.
BE IT ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
The Short Title of this Act shall be “The Lodgers Franchise Act, 1875.”
2 Persons living in lodgings qualified to vote at elections of members of House of Representatives under certain conditions.
Besides the qualifications which immediately before the passing of this Act entitled persons to vote in the election of members of the House of Representatives, every male person shall, in and after the year commencing on the first day of January, one thousand eight hundred and seventy-six, be entitled to be registered as a voter and, when registered, to vote for a member or members to serve in the House of Representatives for an electoral district, who is qualified as follows, that is to say,—
1.
Is of full age and not subject to any legal incapacity; and
2.
As a lodger has occupied in the same electoral district separately and as a sole tenant, for twelve months preceding the last day of December in any year, the same lodgings, such lodgings being part of one and the same dwelling-house, and of a clear yearly value, if let unfurnished, of ten pounds or upwards; and
3.
Has resided in such lodgings during the twelve months immediately preceding the last day of December in such year, and has claimed to be registered as a voter at the next ensuing registration of voters.
3 Claimant to vote to apply to the Returning Officer of the district.
Every person claiming to be allowed to vote under this Act shall make application to the Returning Officer of the district in regard to which he claims to be entitled to vote in the mode prescribed in the Schedule hereto: Provided that such notice shall be lodged with the Returning Officer at the times prescribed for the reception of claims to vote at such elections, and shall be dealt with in like manner with such claims to vote.
4 Such qualification to be in addition to existing qualifications.
The qualifications created by this Act shall be in addition to and not in substitution for any existing qualifications, but so that no person shall be entitled to vote for the same electoral district for more than one qualification.
5 Certain provisions of Constitution Act and of other enactments to apply.
The provisions contained in the fourth, sixth, eighth, and forty-second sections of the Constitution Act, and all other enactments relating to qualifications of electors and candidates, and to the registration of persons entitled to vote, and to the election of members of the House of Representatives, Superintendents of Provinces, and members of Provincial Councils, shall be construed and read as if the enactments contained in the second section hereof were contained in the seventh section of the Constitution Act, and shall apply, as nearly as circumstances admit, to any person hereby authorized to vote and to the qualification hereby created.
