An Act to enable the Governor to make a Grant of Six Hundred Acres to James Riddell.
Preamble.
WHEREAS by an award of the Compensation Court, given under “The New Zealand Settlements Act, 1863,”
in respect of the Ngatiruanui Coast Block, at a sitting held at Wanganui on the twelfth day of December, one thousand eight hundred and sixty-six, one Herona Hineihara became entitled to a Crown grant of the land described in the First Schedule hereto: And whereas by an award of the same Court, made on or about the same date, one Horopapera Pukeke became entitled to receive a Crown grant of the land described in the Second Schedule hereto,’ and afterwards to a piece of land adjoining thereto in lieu thereof: And whereas the said Herona Hineihara executed a lease of the piece of land described in the First Schedule to Henry Shakespeare Taylor, and the said Horopapera Pukeke executed a conveyance to the said Henry Shakespeare Taylor of the piece of land described in the Second Schedule: And whereas the said Henry Shakespeare Taylor, by deed bearing date the twenty-sixth day of May, one thousand eight hundred and seventy-two, assigned and conveyed unto James Riddell, his heirs, executors, administrators, and assigns, the said two pieces of land described in the First and Second Schedules respectively, but, as to the piece of land described in the First Schedule, only the lease thereof, and the said James Riddell immediately took possession, and began to cultivate the same: And whereas shortly afterwards a number of aboriginal natives, from whom the land had been confiscated, laid claim to the said two pieces of land, and have since continued to occupy the same, and have destroyed or taken away crops and sheep belonging to the said James Riddell which were upon the same: And whereas it is expedient that, upon the said James Riddell conveying and assigning all his interest in the said two pieces of land respectively to Her Majesty, the Governor should be authorized to make on behalf of Her Majesty a grant not exceeding six hundred acres to the said James Riddell, in exchange for the said pieces of land:
Be it therefore enactedby the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
The Short Title of this Act shall be “The Riddell Grant Act, 1875.”
2 Power to Governor to grant six hundred acres upon conveyance to Crown of lands described in Schedules.
It shall be lawful for, but not obligatory on the Governor, in the name and on behalf of Her Majesty, upon the said James Riddell executing a conveyance and assignment to Her Majesty of all his estate and interest in the pieces of land in the First and Second Schedules hereto respectively described, and upon the production by the said James Riddell to the Secretary of Crown Lands of a receipt or other satisfactory evidence showing that the said Henry Shakespeare Taylor has been paid in full all moneys due to him from the said James Riddell, to make and execute a Crown grant to the said James Riddell of six hundred acres out of any lands taken under “The New Zealand Settlements Act, 1863,”
or any Act amending the same; and the said James Riddell shall be entitled to select in one or more block or blocks out of such lands as aforesaid the area he is hereby declared entitled to select, and such selection shall be made within six months from the passing of this Act.
3 Grant to be in lieu of all claims for compensation.
The said grant shall be issued without payment of any purchase money for such lands so to be selected, and shall be taken and accepted in lieu of all claims and demands of whatsoever nature (if any) the said James Riddell may have against Her Majesty, or against any other person or persons, in respect of or arising out of the matters mentioned or referred to in the preamble hereto.
4 Grant to be subject to “The Crown Grants Act, 1866,”
and amending Acts.
The said grant shall be made subject to the provisions of “The Crown Grants Act, 1866,”
and the several Acts amending the same, and shall be prepared and issued in accordance with the said Acts.
SCHEDULES
FIRST SCHEDULE Province of Wellington
All that piece or parcel of land containing 400 acres, more or less, situate in the Okotuku district, being the section formerly known as number 11a, but now numbered 386 on the map of the said district, and bounded towards the North by Section numbered 385; towards the East by the said Section numbered 385, and by the Waitotara River; towards the South by the Waitotara River; and towards the West by Section numbered 387.
SECOND SCHEDULE Province of Wellington
All that piece or parcel of land containing 400 acres, more or less, situate in the Okotuku district, being the section formerly known as number 10a, but now numbered 387 on the map of the said district, and bounded towards the North by Sections numbered 378 and 379; towards the East by Sections numbered 385 and 386; towards the South-east by the Waitotara River; and towards the South-west by the Monahaki Stream.
