An Act to extend the Appropriation Acts or Ordinances of the several Provinces until the Thirtieth day of September, One thousand eight hundred and seventy-six.
Preamble.
WHEREAS by the several Acts or Ordinances mentioned in the Schedule hereto annexed, the Superintendents and Provincial Councils of the several provinces in New Zealand have appropriated various moneys of the public revenues of such provinces for the periods in the said Schedule particularly mentioned: And it is expedient that the public revenues of the provinces should be appropriated until the thirtieth day of September, one thousand eight hundred and seventy-six:
Be it therefore enacted by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
This Act shall be called “The Provincial Appropriations Extension Act, 1875.”
2 Current expenditure provided for till 30th September, 1876.
The appropriation by each of the Appropriation Acts or Ordinances mentioned in the Schedule hereto annexed of any moneys for the payment of salaries, and of the miscellaneous and contingent current expenses in the maintenance of the Government of the province to which such Act or Ordinance relates, is hereby extended from the date of the expiration thereof until the thirtieth day of September, one thousand eight hundred and seventy-six, so that all such salaries and expenses shall be payable until the said thirtieth day of September, upon the same scale as in such Act or Ordinance set forth.
3 Expenditure on public works provided for till 30th September, 1876, with consent of the Governor.
Where by any such Act or Ordinance money is appropriated for any public work or other special service, the Superintendent of the province may, subject to the provisions of the twenty-sixth section of “The Abolition of Provinces Act, 1875,”
enter into any contract or incur any expense for the execution or performance of such work or service on or before such thirtieth day of September, one thousand eight hundred and seventy-six: Provided that no such contract shall be entered into or expense be incurred without the consent of the Governor, by which the total expenditure of such province shall exceed the total estimated revenues thereof for the period ending on the said thirtieth day of September, one thousand eight hundred and seventy-six; and the estimate of such revenue shall be made by the Superintendent, and on being approved of by the Governor shall be deemed to be the total estimated revenue for the purposes of this Act.
4 Governor and Superintendent may agree to spend excess of revenue.
In case the public revenues of any province estimated to be received before the thirtieth day of September, one thousand eight hundred and seventy-six, exceed the expenditure chargeable thereon under any such Act or Ordinance as aforesaid and under this Act, the Superintendent of such province may agree with the Governor as to any public work or works, grants to Road Boards or other local bodies, or for any public service for the benefit of such province on which such excess may be spent, and may, with the consent of the Governor, but not otherwise, contract for or otherwise incur the expense of the execution of such work or works, grants or services, at any time on or before the said thirtieth day of September, one thousand eight hundred and seventy-six; and all moneys so expended shall be deemed to have been appropriated by the Legislature of such province.
5 Advances may be made in aid of revenues. Of Auckland, £60,000. Of Westland, £32,000.
In case the revenues of the Provinces of Auckland or Westland shall be insufficient to provide for the expenditure chargeable thereon respectively, by the Appropriation Act or Ordinance in force in each of the said provinces, or by this Act, the Colonial Treasurer may, at any time on or before the thirtieth day of September, one thousand eight hundred and seventy-six, make advances out of the Consolidated Fund in aid of the revenues of either of the said provinces to the extent of such deficiency: Provided that such advances shall not exceed in the whole the sum of sixty thousand pounds in aid of the revenues of the Province of Auckland, nor thirty-two thousand pounds in aid of the revenues of the Province of Westland.
6 Treasury bills to the amount of £92,000 authorized.
For the purpose of enabling the advances authorized by the fifth section of this Act to be made out of the Consolidated Fund, it shall be lawful for the Colonial Treasurer from time to time, in aid or in anticipation of revenue, to cause any number of Treasury bills to be made out at the Colonial Treasury, for any sum or sums of money not exceeding in the whole the sum of ninety-two thousand pounds sterling, and the proceeds of the sale of such bills shall be paid into the Consolidated Fund.
All such Treasury bills shall be prepared made out and issued under the authority of and in the manner prescribed by “The Treasury Bills Regulations Act, 1868,”
and “The Treasury Bills Regulations Act Amendment Act, 1869,”
and may bear interest at any rate not exceeding six pounds for every one hundred pounds (£100) by the year in respect of the whole moneys contained therein: Provided always that the currency of the said hills shall in no case he made to extend beyond the first day of November, one thousand eight hundred and seventy-seven.
7 Special orders must be assented to by the Governor.
After the passing of this Act, it shall not be lawful for the Superintendent of any province under the authority of the twelfth section of “The Provincial Audit Act, 1866,”
or under any other authority, to issue any special order directing the Provincial Auditor to certify any warrant for the issue of money in excess of or without the appropriation of the Superintendent and Provincial Council of such province, nor for the Provincial Auditor to certify any warrant in obedience to any such special order, unless such special order shall have been first assented to by the Governor, and every such special order and warrant shall without the Governor’s assent be null and void.
