An Act to repeal parts of certain Acts authorizing the Expenditure of certain Sums of Money for the purposes of Immigration and Public Works, and to appropriate further Sums in that behalf.
Preamble.
MOST GRACIOUS SOVEREIGN,—Whereas by the several Acts of the General Assembly mentioned in the First Schedule to this Act certain sums of money, amounting in the whole to the sum of ten million seven hundred and fifty thousand pounds, were authorized to be raised by loan; and by the said Acts, and by the several Acts mentioned in the Second Schedule to this Act, various sums of the moneys so to be raised were authorized to be issued and applied to the several works and services mentioned in the said Acts and the Schedules thereto; and various sums of money, amounting in the whole to the sum of seven millions and eighty-one thousand four hundred and sixty pounds five shillings and fourpence, have been so issued and applied as in the third column of the Third Schedule to this Act set forth: And whereas it is expedient that the several authorities in the said Acts contained should be repealed, and that the unexpended balance of the moneys so authorized to be raised, together with other moneys in the Fourth Schedule mentioned, should be appropriated from year to year, as the same may be required, for carrying on the said several works and services as in the said Third Schedule mentioned:
We, your Majesty’s most dutiful and loyal subjects, the House of Representatives of New Zealand, in Parliament assembled, have resolved to grant unto your Majesty, towards making good the Supply which we have cheerfully granted to your Majesty in this Session of Parliament, the sums hereinafter mentioned, and do therefore most humbly beseech your Majesty that it may be enacted, and
Be it enacted by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
This Act shall be called “The Immigration and Public Works Appropriation Act, 1875,”
and shall be deemed to have been in operation on and after the first day of July, one thousand eight hundred and seventy-five.
2 Repeal of former appropriations.
So much of any and all of the Acts mentioned in the First and Second Schedules to this Act as appropriate or purport to appropriate any moneys raised or to be raised under the authority of the Acts mentioned in the First Schedule to this Act, or of either of them, or of any other moneys whatsoever, is hereby repealed, and it shall not be lawful to issue or pay any of the moneys mentioned in the Fourth Schedule hereto except under the authority of this Act or of any Act or Acts hereafter to be passed in that behalf.
3 Money to be kept in one account, called “The Public Works Account.”
The several Ways and Means mentioned in the Fourth Schedule to this Act, and all moneys which may come to the credit thereof, shall be kept in one account, to be called “The Public Works Account.”
4 Grant of £3,587,662 10s. 8d.
Towards defraying the expenses hereinafter mentioned, the Colonial Treasurer may issue and apply any sum or sums of money not exceeding in the whole the sum of three million five hundred and eighty-seven thousand six hundred and sixty-two pounds ten shillings and eightpence out of the several Ways and Means mentioned in the Fourth Schedule to this Act.
5 Appropriation.
All sums so issued shall be applied, as mentioned in the several votes set forth in the Fifth Schedule to this Act, towards defraying so much of the expenses incurred or to be incurred in the several works and services in the said Schedule mentioned as shall come in the course of payment during the financial year ending the thirtieth day of June, one thousand eight hundred and seventy-six, and to no other purposes whatsoever.
6 Issue to temporary general account.
Whenever it is not possible to determine at the time of payment to which particular vote mentioned in the Fifth Schedule hereto the cost of any material or other expense should be charged, the Colonial Treasurer may notwithstanding issue and pay the same out of the several Ways and Means mentioned in the Fourth Schedule hereto: Provided that he shall from time to time carry each such payment to and charge the same against the vote on account of which such payment was made, so soon as the same can be ascertained: Provided also that all such expenditure shall be included in and shall not be in excess of the total sum hereby authorized to be issued and paid under each vote in the Fifth Schedule mentioned.
7 Power to alter votes. Unauthorized expenditure.
Nothing in this Act shall limit the authority of the Colonial Treasurer to issue and pay any moneys which he may be otherwise authorized to issue and pay under the authority of the thirtieth section of “The Public Revenues Act, 1867,”
or of the fourteenth section of “The Public Revenues Act, 1872.”
8 Indemnity.
And whereas the Colonial Treasurer has under the authority of the fourteenth section of “The Public Revenues Act, 1872,”
issued from the Public Account, during the year ending the thirtieth day of June, one thousand eight hundred and seventy-five, moneys in excess of or without the appropriation of Parliament, amounting in the whole to thirty-two thousand two hundred and fifty-four pounds nine shillings and elevenpence, and has applied the said sum to the several purposes and services mentioned in the Sixth Schedule hereto annexed: Be it enacted that the application of the said sum is hereby sanctioned.
9 Short-dated debentures may be paid off.
And whereas by the several Acts mentioned in the First Schedule hereto annexed it was provided that, pending the raising of the several loans thereby authorized, any sum or sums of money not exceeding in the whole the several sums thereby authorized to be raised might be taken up by the sale hypothecation or mortgage of short-dated debentures:
Be it enacted,—
The Colonial Treasurer may from time to time, out of moneys raised or to be raised by loan under the authority of any or all of the Acts mentioned in the said First Schedule, pay off any sum or sums of money so taken up by the sale hypothecation or mortgage of short-dated debentures under the authority of any of the said Acts.
10 Temporary advance to Defence Loan.
The Colonial Treasurer may from time to time advance out of the Ways and Means mentioned in the Fourth Schedule hereto annexed any sum or sums of money not exceeding in the whole the balance of the moneys authorized to be raised under the authority of “The Defence Loan Act, 1870,”
and not yet so raised; and all moneys so advanced shall be repaid out of moneys to be raised under the authority of the said Act so soon as the same are raised.
