Contents

An Act to apply a Sum of Money out of the Consolidated Fund and other Moneys to the Service of the Year ending the Thirtieth day of June, One thousand eight hundred and seventy-six, and to appropriate the Supplies granted in this present Session.

MOST GRACIOUS SOVEREIGN,—We, Your Majesty’s most dutiful and loyal subjects, the House of Representatives of New Zealand in Parliament assembled, towards making good the Supply which we have cheerfully granted to Your Majesty in this Session of Parliament, have resolved to grant unto Your Majesty the sums hereinafter mentioned, and do therefore most humbly beseech Your Majesty that it may be enacted, and be it enacted, by the General Assembly of New Zealand in this present Parliament assembled, and by the authority of the same, as follows:—

1 Short Title.

The Short Title of this Act shall be “The Appropriation Act, 1875.”

GRANTS OUT OF THE PUBLIC ACCOUNT

2 Grant of £1,072,637 2s., and fees.

The Colonial Treasurer for the time being may issue out of the Public Account, and apply towards making good the Supplies granted to Her Majesty for the services of the year ending on the thirtieth day of June, one thousand eight hundred and seventy-six, the several sums in the Schedule A hereto annexed, particularly mentioned, amounting in the whole to the sum of one million and seventy-two thousand six hundred and thirty-seven pounds two shillings (£1,072,637 2s.), together with the amount of the fees hereinafter mentioned, the said moneys being inclusive of, and not in addition to, any sums issued out of the Public Account under the authority of “The Imprest Supply Act, 1875,” and “The Imprest Supply Act (No. 2), 1875.”

APPROPRIATION OF GRANTS

3 Appropriation of £872,550 8s. 10d out of Consolidated Fund, and fees.

(1.)

All sums hereby granted out of the Consolidated Fund, amounting, as appears by the said Schedule A, to eight hundred and seventy-two thousand five hundred and fifty pounds eight shillings and tenpence (£872,550 8s. 10d.), together with the fees collected by such public officers as are authorized to retain the same in lieu of salary, are appropriated for the purposes and services expressed in the several votes in the Schedule B annexed hereto.

Appropriation of £103,500 out of Defence Loan.

(2.)

All sums hereby granted out of moneys raised or to be raised under the authority of “The Defence Loan Act, 1870,” amounting, as appears by the said Schedule A, to one hundred and three thousand five hundred pounds (£103,500), are appropriated for the purposes and services expressed in the several votes in the Schedule C annexed hereto.

Appropriation of £79,851 13s. 2d out of Land Fund.

(3.)

All sums hereby granted out of the Land Fund, amounting, as appears by the said Schedule A, to seventy-nine thousand eight hundred and fifty-one pounds thirteen shillings and twopence (£79,851 13s. 2d.), are appropriated for the purposes and services expressed in the several votes in the Schedule D annexed hereto. If the Land Fund of any province shall be insufficient to meet such charges, the Colonial Treasurer may advance out of the Consolidated Fund such sums as may be necessary to make up such deficiency, and all such advances shall be repaid to the Consolidated Fund out of the first proceeds of such Land Fund.

Appropriation of £16,735 out of Trust Funds.

All sums hereby granted out of the Trust Funds, amounting, as appears by the said Schedule A, to sixteen thousand seven hundred and thirty-five pounds (£16,735), are appropriated for the purposes and services expressed in the several votes in the Schedule E annexed hereto.

4 Schedules included in the Act.

The Schedules annexed hereto, with the notes, if any, to such Schedules, shall be deemed to be part of this Act, in the same manner as if they had been contained in the body thereof.

5 Railway Stores and Workshops Account.

The Colonial Treasurer may issue and pay out of the Consolidated Fund any sum not exceeding in the whole the sum of twenty thousand pounds during the current financial year, to provide for the purchase of stores and the cost of maintaining the workshops for the working of the railways mentioned in the Schedule B hereto annexed: Provided that he shall from time to time charge the whole of the money so issued against the several railways mentioned in the said Schedule, in the proportion in which such stores and the work executed in such workshops are used upon each such railway, and provided also that each vote for the working of such railways, as set forth in Schedule B, shall not be thereby exceeded.

6 Expenses of Native Land Court and Inspector of Surveys’ Department charged provincially.

The expenses of the Native Land Court hereby authorized shall be charged against the several provinces in proportion to the time which the said Court shall have sat in each province during the current financial year, or as to past liabilities during the year in which such expenses were incurred.

The expenses of the Inspector of Surveys’ Department hereby authorized shall be charged against the several provinces in proportion to the number of acres surveyed and inspected in each province during the current financial year, or as to past liabilities during the year in which such expenses were incurred.

Advances may be made from Native Land Purchase votes.

If the revenues accruing within any province under the Native Lands Act shall be insufficient to meet the charges for the Native Land Court and the Inspector of Surveys’ Department hereby authorized, the Colonial Treasurer may advance such sums as may be necessary to meet such deficiency out of the moneys authorized by “The Public Works Appropriation Act, 1875,” to be applied to the purchase of Native lands within such province.

The balance of such advances found to be outstanding on the thirtieth June, one thousand eight hundred and seventy-six, shall be charged against the province in aid of which such advances have been made; and the interest and sinking fund payable by the colony in respect of such advances shall be charged against such province in the manner provided by the forty-fourth section of “The Public Revenues Act, 1867,” and the fifth section of “The Public Revenues Act Amendment Act, 1871.”

7 Indemnity.

And whereas the Colonial Treasurer has, under the authority of the fourteenth section of “The Public Revenues Act, 1872,” issued from the Public Account, during the year ending the thirtieth day of June, one thousand eight hundred and seventy-five, moneys in excess of or without the appropriation of Parliament, amounting in the whole to the sum of seventy-five thousand eight hundred and sixty-seven pounds ten shillings and fivepence (£75,867 10s. 5d.), and has applied the said sum to the several purposes and services mentioned in the Schedule F hereto annexed: Be it enacted that the application of the said sums is hereby sanctioned.

8 Public Trust Office.

And whereas by the eleventh section of “The Public Trust Office Act, 1872,” it is enacted that the salary of the Public Trustee and of the other officers and servants in the Public Trust Office shall be such as shall be fixed by the General Assembly: Be it enacted that the said salaries for the year ending the thirtieth day of June, one thousand eight hundred and seventy-six, shall be those mentioned in Schedule G hereto annexed.
