WHEREAS by deed bearing date the twenty-ninth day of June, one thousand eight hundred and sixty-four, Rakiura, or Stewart Island, was ceded to the Crown by the Native owners thereof, one of the terms of the said cession being that certain land at the Neck, Paterson’s Inlet, should be reserved for and divided amongst the half-castes resident thereon, and that the remainder of such land, after the said half-castes had been provided for, should be for Ihaia Whaitiri and Hoani Tunarere, two aboriginal natives: And whereas by “The Stewart Island Grants Act, 1873,” provision was made for the issue of Crown grants in satisfaction of the terms of the deed of cession to all the half-castes entitled thereto, but the said Act failed to give any authority to the Governor to execute Crown grants to the above-named aboriginal natives: And whereas after the claims of all the half-castes aforesaid have been completely satisfied, there are found to be remaining at the Neck above named about forty-five acres of land, more or less, which it is just and proper the Governor should be authorized to grant to the two Natives hereinabove named, in accordance with the deed of cession, in the proportions mentioned in the Schedule, such proportions having been settled to the satisfaction of such Natives by the Land Claims Commissioner to whom the matter was referred for investigation:
