An Act to amend “The Masterton and Greytown Lands Management Act, 1871.”
Preamble.
WHEREAS it is expedient to amend “The Masterton and Greytown Lands Management Act, 1871,”
(hereinafter cited as “the said Act,”
) in order to remove certain doubts which have arisen with respect to the title to an acre of land mentioned in the Second and Third Schedules to the said Act, being Town Acre numbered forty-seven, in the Township of Masterton, intended to be set apart and conveyed as a site for a Roman Catholic church: And whereas it is expedient that full power and authority should be granted to “the Masterton Trustees,”
being such Trustees under the provisions of the twenty-fourth clause of the said Act, to convey to the Bishop of the Roman Catholic Church, in Wellington, and his successors, the Town Acre in the Township of Masterton hereinbefore referred to, on trust as a site for a Roman Catholic church: And whereas further certain lands intended to be included in the First Schedule to the said Act were accidentally omitted therefrom:
Be it therefore enacted by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
The Short Title of this Act shall be “The Masterton and Greytown Lands Management Act 1871 Amendment Act, 1876.”
2 Greytown Trustees.
With respect to the lands and hereditaments mentioned in the Schedule hereto, all the estate and interest therein at present vested in Charles Rooking Carter shall, on the passing hereof, vest without conveyance in Thomas Kempton, junior, William Bennett Allen, Meyer Caselberg, Joseph Payton, Charles William Hornblow, and Thomas Walker, all of Grey town, as joint tenants in fee-simple, and as trustees of the said lands and hereditaments under the provisions of “The Masterton and Greytown Lands Management Act, 1871.”
3 Masterton Trustees may convey Town Acre No. 47 to Roman Catholic Bishop of Wellington.
It shall he lawful for “the Masterton Trustees”
for the time being, at any time after the passing of this Act, to execute a deed of conveyance of the fee-simple of Town Acre number forty-seven, in the Township of Masterton, with all the appurtenances thereto, to the present Roman Catholic Bishop of Wellington and his successors, to be held on trust for the purposes of the Roman Catholic Church, and such deed of conveyance shall vest the fee-simple of the said Town Acre number forty-seven, in the Township of Masterton, in the Roman Catholic Bishop of Wellington and his successors, and the land so conveyed shall be inalienable: Provided that in any such deed of conveyance the trusts and purposes upon which any such deed is executed, as hereinbefore provided, shall be fully set forth on the face of the said deed, and provided further that if the said land shall be used for any other purpose, then the said deed executed under the authority of this Act shall be null and void.
