An Act to change the Purposes for which certain Reserves were set aside in the City of Dunedin;

Preamble.

WHEREAS the lands described in the First Schedule have been granted to the Superintendent of the Province of Otago in trust for wharves and quays: And whereas the lands described in the Second Schedule have also been granted to the said Superintendent in trust for market purposes: And whereas the reserves described in the Third Schedule have been granted to the said Superintendent in trust for recreation and city purposes, and the Superintendent and Provincial Council of Otago have by Ordinance set the said reserves apart for educational purposes, and it is desirable that the said reserves should be vested in the Education Board: And whereas it is desirable that the purposes for which these reserves were set aside should be changed, and that these lands should be held in trust for educational purposes:

Be it therefore enacted by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—

1 Short Title.

The Short Title of this Act shall be “The Dunedin Reserves Exchange Act, 1876.”

2 Lands vested in Education Board for educational purposes.

The lands described in the First, Second, and Third Schedules hereto, shall be and the same are hereby vested in the Education Board for the time being of the Province of Otago, in trust for educational purposes.

SCHEDULES

FIRST SCHEDULE

All that parcel of land in the Province of Otago, in the Colony of New Zealand, containing by admeasurement two (2) roods and twenty (20) poles, more or less, situate in the City of Dunedin, being Subdivisions numbered respectively 11, 12, and 13, parts of Block I., Wharves and Quays Reserve. Bounded by a line commencing at a point two hundred and fifty (250) links distant from the intersection of the eastern side of Fourth Street with the southern side of Albany Street, as measured in an easterly direction along Albany Street, and proceeding from the said point along a line at a right angle with Albany Street and in a southerly direction, two hundred and fifty (250) links, to old high watermark; thence in an easterly direction along old high watermark, three hundred and five (305) links, to the boundary line between Subdivisions numbered respectively 10 and 11; thence along the aforesaid boundary line to Albany Street, one hundred and ninety-eight (198) links; thence along Albany Street in a westerly direction, three hundred (300) links, to the starting point.

SECOND SCHEDULE

All that parcel of land in the Province of Otago, in the Colony of New Zealand, containing by admeasurement one (1) rood and thirty-three (33) poles, more or less, situate in the City of Dunedin, being Section numbered 30 and parts of Sections numbered respectively 29 and 34, Block XVII., on the map of the said city. Bounded towards the North-north-west by Moray Place, one hundred and ninety-four and sixty-seven hundredths (194·67) links; towards the East by Sections numbered respectively 31 and 33, five hundred and eight and seventy-two hundredths (508·72) links; and towards the West-south-west by other parts of the said Sections numbered respectively 29 and 34, four hundred and seventy (470) links.

THIRD SCHEDULE

All that parcel of land, being Sections 33, 34, 35, 36, 37, and 38, Block XIII., Dunedin.
