An Act to amend the Law relating to the Collection of Tolls in the Provinces of Otago and Wellington.

BE IT ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—

1 Short Title.

The Short Title of this Act shall be “The Otago and Wellington Tolls Act, 1876.”

2 Commencement of Act.

This Act shall come into operation on and after the thirtieth day next after the passing hereof, which date is hereafter called the commencement of this Act.

3 Tolls in Otago.

On and after the commencement of this Act, the Schedule to “The Turnpikes Ordinance 1866 Amendment Ordinance, 1875,” of the Superintendent and Provincial Council of the Province of Otago, shall be and the same is hereby repealed, and the First Schedule to this Act shall be substituted for the said repealed Schedule, and the third clause of the said “Turnpikes Ordinance 1866 Amendment Ordinance, 1875,” of the Superintendent and Provincial Council of the Province of Otago, shall be read and interpreted as if the said First Schedule to this Act had been inserted in “The Turnpikes Ordinance 1866 Amendment Ordinance, 1875,” hereinbefore referred to in lieu of the Schedule to the said Ordinance hereby repealed, anything in the said clause to the contrary notwithstanding.

4 Tolls in Wellington.

On and after the commencement of this Act, the Schedule to “The Wellington Toll Gates Act, 1875,” of the General Assembly of New Zealand, shall be and the same is hereby repealed, and in lieu thereof it is enacted that the tolls to be charged at any toll-gate now established or hereafter to be established under the provisions of any law for the time being in force in the Province of Wellington shall be those set forth in the Second Schedule to this Act, anything in any Act contained to the contrary notwithstanding.

Proviso.

Provided that so soon as “The Counties Act, 1876,” shall come into operation, it shall be lawful for the County Council of any county within the Provincial District of Wellington from time to time to fix or alter the tolls authorized in the Second Schedule to this Act to be collected at any toll-gate established or hereafter to be established by law within the boundaries of such county: Provided further that any such fixture or alteration shall be publicly notified and posted as required by the provisions of “The Public Works Act, 1876,” respecting tolls.

SCHECULES

FIRST SCHEDULE

1.

For every horse or other beast drawing any coach, landau, barouche, chaise, phaeton, curricle, car, or any such like carriage, sixpence.

2.

For every horse or other beast drawing any wagon, wain, or other such like conveyance, if the total number shall not exceed six, sixpence; and for every extra horse or other beast above the number of six as aforesaid, and not exceeding eight, one shilling; and for every extra horse exceeding the number of eight, two shillings.

3.

For every horse or other beast, if the total number shall not exceed three, drawing any Whitechapel cart or dray on two wheels, sixpence.

4.

For every horse or other beast, if the total number shall exceed three, drawing any Whitechapel cart or dray on two wheels, one shilling.

5.

For every horse, mule, or ass, laden or unladen, and not drawing, sixpence.

6.

For every drove of horses, mules, and asses, unladen or not drawing, threepence per head.

7.

For every drove of oxen, cows, or neat cattle, the sum of three shillings and fourpence per score, and so in proportion for any greater or less number.

8.

For every drove of calves, swine, goats, sheep, or lambs, the sum of tenpence per score, and so on in proportion for any greater or less number.

Provided that in the interpretation of clauses 2 and 3 of this Schedule, the term “horse” shall mean and include two oxen or neat cattle.

SECOND SCHEDULE

This Schedule shall be read as if the words “mare, gelding, ass, mule, bull, cow, or calf” were inserted after the word “horse” throughout: Provided that not more than one toll shall be taken on any vehicle or horse passing or returning on the same day: And provided further that in the case of a vehicle without springs having the tires of all its wheels of a breadth of not less than five inches, the wheels being so formed that a surface of not less than five inches comes in contact with the ground on a firm cart road, the amount of tolls shall be one-half the rate which would otherwise he charged under this Schedule.
