An Act to enable the Governor to make a Crown Grant to the Superintendent of Hawke’s Bay, for the purposes of a Site for a Hospital and Grounds, of a piece of Land situate at Napier, known as the Barrack Reserve, and to enable the Superintendent to lease a certain piece of Land set aside as a Hospital Reserve.
Preamble.
WHEREAS the piece of land described in the First Schedule hereto has been set aside as a site for a barracks: And whereas the piece of land described in the Second Schedule hereto has been set aside as a reserve for purposes of public utility, and has been used as a site for a hospital, and a Crown grant thereof has been made to the Superintendent of the Province of Hawke’s Bay: And whereas such last-mentioned piece of land has been found to be an unsuitable site for the purposes of a hospital: And whereas it is expedient that the piece of land described in the First Schedule should be granted to the Superintendent of the Province of Hawke’s Bay as a site for a hospital and grounds, and that he should be empowered to lease the lands described in the Second Schedule:
Be it therefore enacted by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
The Short Title of this Act shall be “The Napier Hospital Site Act, 1876.”
2 Governor may grant to Superintendent of Hawke’s Bay the land described in First Schedule as a site for a hospital.
It shall be lawful for the Governor to make and execute a Crown grant to the Superintendent of the Province of Hawke’s Bay (hereinafter called “the Superintendent”
) of the piece of land described in the First Schedule, to be held by him as the site for a hospital and grounds.
3 Superintendent authorized to lease lands in Second Schedule. Proviso.
It shall be lawful for the Superintendent to make and execute a lease or leases of the whole or portion of the land described in the Second Schedule, for periods not to exceed thirty-five years, subject to such conditions as he shall think fit: Provided that such lease or leases shall be sold by public auction after two months’ notice in one or more newspapers published at Napier.
4 Proceeds to be devoted to hospital.
The rents and profits arising out of the lands so leased shall be expended in the maintenance and endowment of the hospital to be erected on the land described in the First Schedule.
SCHEDULES
FIRST SCHEDULE
All that parcel of land in the Town of Napier, Province of Hawke’s Bay, containing by admeasurement three acres two roods nine perches, more or less, being portion of a public reserve known as Barrack Reserve. Bounded to the North-east by other portions of the same reserve, seven hundred and forty (740) links; to the South by Spenser Road; to the South-west by Suburban Section N.o. 6 and Park Road, two hundred and seventy (270) links; to the North-west by Suburban Sections Nos. 8 and 9, seven hundred (700) links.
SECOND SCHEDULE
All that parcel of land in the Town of Napier, Province of Hawke’s Bay, containing by admeasurement one acre three roods. Bounded on the North by Harvey Street, eight hundred and forty (840) links; on the South-west by Suburban Section No. 61, five hundred and fifty (550) links; on the South-east by Town Sections Nos. 413, 414, 415, four hundred and forty-five (445) links, excepting thereout a public road fifty (50) links wide, intersecting the said parcel of land.
