An Act to validate a Conveyance from the Superintendent of the Province of Otago to “The Otago Presbyterian Church Board of Property.”
Preamble.
WHEREAS, in order to enable the Corporation of the City of Dunedin to widen a portion of Princes Street in such city, the said Board has agreed to convey certain land to the said Corporation, and in lieu thereof the Superintendent of the Province of Otago has conveyed to the said Board the land described in the Schedule hereto, but doubts exist as to the effect of such conveyance:
Be it therefore enacted by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
The Short Title of this Act shall be “The Otago Presbyterian Church Conveyance Validation Act, 1876.”
2 Conveyance from the Superintendent to “The Otago Presbyterian Church Board of Property”
validated.
The conveyance from the Superintendent of the Province of Otago to “The Otago Presbyterian Church Board of Property”
dated the seventh day of April, one thousand eight hundred and seventy-six, of the lands mentioned and described in the Schedule hereto, shall be, and the same is hereby declared to be, valid and effectual to all intents and purposes from the date thereof.
3 Interpretation claues.
This Act, “The Presbyterian Church of Otago Incorporation Act, 1875,”
and the several Acts and Ordinances therein mentioned or referred to, shall be read together, and the word “Synod”
in such Acts and Ordinances shall mean the Synod or other highest Church Court for the time being of the Presbyterian Church, now called the Presbyterian Church of Otago and Southland, in the Province of Otago, such Court having jurisdiction limited to such province exclusively, notwithstanding that the said Church may become united to or form part of any other Presbyterian Church or Churches in the Colony of New Zealand.
Schedule
All that parcel of land in the Province of Otago, in the Colony of New Zealand, containing by admeasurement 28 poles, more or less, situate in the City of Dunedin, being part of area Crown-granted to the Superintendent, in trust for harbour reclamation, and now known as part of block numbered XXXIX. on the map of the said city, bounded by a line commencing at a point in Bond Street at the eastern angle of section numbered 12, and proceeding in a west-north-westerly direction at a right angle to Bond Street, one hundred and forty-seven (147) links, to old high watermark; thence in a north-easterly direction along old high watermark, bounded by land known as the Manse Reserve No. 10 on the plan of Dunedin, two hundred (200) links; thence in an east-south-easterly direction along a line parallel to the first-mentioned line, eighty-five (85) links, to Bond Street; thence in a south-south-westerly direction along Bond Street, one hundred and seventy-seven (177) links, to the starting point, be all or any of the aforesaid linkages a little more or less.
