Contents
An Act to apply a Sum of Money out of the Consolidated Fund and other Moneys to the Service of the Year ending the Thirtieth day of June, One thousand eight hundred and seventy-eight, and to appropriate the Supplies granted in this present Session.
MOST GRACIOUS SOVEREIGN—We, Your Majesty’s most dutiful and loyal subjects, the House of Representatives of New Zealand in Parliament assembled, towards making good the Supply which we have cheerfully granted to Your Majesty in this Session of Parliament, have resolved to grant unto Your Majesty the sums hereinafter mentioned, and do therefore most humbly beseech Your Majesty that it may be enacted, and be it enacted by the General Assembly of New Zealand in this present Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
The Short Title of this Act shall be “The Appropriation Act, 1877.”
Grants Out of The Public Account
2 Grant of £2,301,642 18s. 1d., and fees.
The Colonial Treasurer for the time being may issue out of the Public Account, and apply towards making good the Supplies granted to Her Majesty for the services of the year ending on the thirtieth day of June, one thousand eight hundred and seventy-eight, the several sums in the Schedule A hereto annexed, particularly mentioned, amounting in the whole to the sum of two million three hundred and one thousand six hundred and forty-two pounds eighteen shillings and one penny, together with the amount of the fees hereinafter mentioned, the said moneys being inclusive of, and not in addition to, any sums issued out of the Public Account under the authority of “The Imprest Supply Act, 1877,”

“The Imprest Supply Act (No. 3), 1877,”
“The Imprest Supply Act (No. 4), 1877,”
“The Imprest Supply Act (No. 5), 1877,”

Appropriation of Grants
3 Appropriation of £1,677,695 16s. 1d. out of Consolidated Fund, and fees.
(1.)
All sums hereby granted out of the Consolidated Fund, amounting, as appears by the said Schedule A, to one million six hundred and seventy-seven thousand six hundred and ninety-five pounds sixteen shillings and one penny, together with the fees collected by such public officers as are authorized to retain the same in lieu of salary, are appropriated for the purposes and services expressed in the several votes in the Schedule B annexed hereto.
Appropriation of £12,000 out of Defence and Other Purposes Loan.
(2.)
All sums hereby granted out of moneys raised or to be raised under the authority of “The Defence and Other Purposes Loan Act, 1870,”
amounting, as appears by the said Schedule A, to twelve thousand pounds, are appropriated for the purposes and services expressed in the several votes in the Schedule C annexed hereto.
Appropriation of £327,846 18s. 9d. out of Provincial Liabilities Account.

All sums hereby granted out of the Provincial Liabilities Account, amounting, as appears by the said Schedule A, to three hundred and twenty-seven thousand eight hundred and forty-six pounds eighteen shillings and ninepence, are appropriated for the purposes and services expressed in the several votes in the Schedule D annexed hereto. The purposes and services chargeable as provincial liabilities shall from time to time be determined by the Governor in Council; but no new liability shall be incurred in respect of provincial liabilities from and after the passing of this Act.
Appropriation of £269,975 3s. 3d. out of Land Fund.

All sums hereby granted out of the Land Bund, amounting, as appears by the said Schedule A, to two hundred and sixty-nine thousand nine hundred and seventy-five pounds three shillings and threepence, are appropriated for the purposes and services expressed in the several votes in the Schedule E annexed hereto. If the Land Fund of any provincial district shall be insufficient to meet the payments charged thereon by this or any other Act, the Colonial Treasurer may, up to thirty-first day of December next, advance out of the Consolidated Fund such sums as may be necessary to make up such deficiency.
The expenses of the Department of the Surveyor-General to the thirty-first day of December next shall be charged upon the Land Fund arising within the several provincial districts, in proportion to the amount expended for surveys in each district up to that date.
Appropriation for Domain Boards and Cemeteries in Canterbury.
(5.)
The moneys appropriated in Schedule E for Domain Boards and cemeteries in the Provincial District of Canterbury shall be distributed in the following proportions:—
(1.)
Two-thirds amongst the Councils of the several counties or parts of counties lying to the north of the river Rangitata, in such proportions as may be directed by a Board composed of the Chairmen of the Counties of Ashley, Selwyn, Ashburton, and Akaroa:
(2.)
One-third amongst the Councils of the several counties or parts of counties lying to the south of the said river, in the proportions fixed by subsection two of section nine of “The Financial Arrangements Act, 1876.”
All such moneys may be expended by the Council of any county in any part of the provincial district in such proportion as it thinks fit.
Appropriation of £14,125 out of Trust Funds.

All sums hereby granted out of the Trust Funds, amounting, as appears by the said Schedule A, to fourteen thousand one hundred and twenty-five pounds, are appropriated for the purposes and services expressed in the several votes in the Schedule F annexed hereto.
4 Railway Stores and Workshops Account.
The Colonial Treasurer may issue and pay out of the Consolidated Fund any sum not exceeding in the whole the sum of one hundred and twenty-five thousand pounds during the current financial year, to provide for the purchase of stores and the cost of maintaining the workshops for the working of the railways mentioned in the Schedule B hereto annexed: Provided that he shall from time to time charge the whole of the money so issued against the several railways mentioned in the said Schedule, in the proportion in which such stores and the work executed in such workshops are used upon each such railway, and provided also that each vote for the working of such railways, as set forth in Schedule B, shall not be thereby exceeded.
5 Indemnity.
And whereas the Colonial Treasurer has, under the authority of the second section of “The Public Revenues Act, 1876,”
issued from the Public Account, during the year ending the thirtieth day of June, one thousand eight hundred and seventy-seven, moneys in excess of or without the appropriation of Parliament, amounting in the whole to the sum of one hundred and twenty-seven thousand six hundred and forty pounds five shillings and elevenpence, and has applied the said sum to the several purposes and services mentioned in the Schedule G hereto annexed: Be it enacted that the application of the said sum is hereby sanctioned.
6 Provision for salaries in Public Trust Office.
And whereas by the eleventh section of “The Public Trust Office Act, 1872,”
it is enacted that the salary of the Public Trustee and of the other officers and servants in the Public Trust Office shall be such as shall be fixed by the General Assembly: Be it enacted that the said salaries for the year ending the thirtieth day of June, one thousand eight hundred and seventy-eight, shall be those mentioned in Schedule H hereto annexed.
7 Moneys payable for works chargeable as provincial liabilities.
The moneys payable under this Act for works chargeable as provincial liabilities may be paid over to such local governing bodies as the Minister for Public Works may determine, upon such terms and conditions as shall be agreed upon between the said Minister and any such local governing body; and the Colonial Treasurer shall make all such payments in accordance with any such agreement.
8 Moneys paid on behalf of local governing bodies may be charged to Suspense Account.
Whenever, under the authority of this or any other Act, any sum of money has been paid on behalf or at the request of any local governing body, the Colonial Treasurer may charge the same to a suspense or advance account within the Consolidated Fund, and every such sum of money so paid may from time to time be deducted from any subsidies or moneys accruing or payable to any such body.
9 After 31st December next balances to be transferred to and moneys issued out of Consolidated Fund.
At the close of business on the thirty-first day of December, one thousand eight hundred and seventy-seven, the Colonial Treasurer shall transfer to the Consolidated Fund the balances standing to the credit of the several accounts which, by the operation of “The Public Revenues Act, 1877,”
become thereafter part of the Consolidated Fund; and the several sums appropriated by this Act and payable out of such several accounts shall, after the said thirty-first day of December, be paid out of the Consolidated Fund.
10 Schedules included in the Act.
The Schedules annexed hereto, with the notes, if any, to such Schedules, shall be deemed to be part of this Act, in the same manner as if they had been contained in the body hereof.
11 Indemnity to Executive Officers acting under “The Abolition of Provinces Act, 1875.”
No person who shall accept or be paid any portion of the sum of two thousand pounds to be paid to Provincial Executive Officers, appropriated in Schedule B to this Act, shall, by reason of such acceptance or payment, incur any liability or be subject to any disability under the provisions of “The Disqualification Act, 1876,”
or to any other disability whatsoever for or by reason thereof.
