An Act to apply a Sum of Money out of the Consolidated Fund and other Moneys to the Service of the Year ending the Thirtieth day of June, One thousand eight hundred and seventy-nine, and to appropriate the Supplies granted in this present Session.

Address.

MOST GRACIOUS SOVEREIGN,—We, Your Majesty’s most dutiful and loyal subjects, the House of Representatives of New Zealand in Parliament assembled, towards making good the Supply which we have cheerfully granted to Your Majesty in this Session of Parliament, have resolved to grant unto Your Majesty the sums hereinafter mentioned, and do therefore most humbly beseech Your Majesty that it may be enacted, and be it enacted by the General Assembly of New Zealand in this present Parliament assembled, and by the authority of the same, as follows:—

1 Short Title.

The Short Title of this Act shall be “The Appropriation Act,1878.”

GRANTS OUT OF THE PUBLIC ACCOUNT

2 Grant of £1,364,608 15s. 8d. and fees.

The Colonial Treasurer for the time being may issue out of the Consolidated Fund, and apply towards making good the Supplies granted to Her Majesty for the services of the year ending on the thirtieth day of June, one thousand eight hundred and seventy-nine, the sum of one million three hundred and sixty-four thousand six hundred and eight pounds fifteen shillings and eightpence, together with the amount of the fees hereinafter mentioned.

APPROPRIATION OF GRANTS

3 Appropriation of £2,364,608 15s. 8d. out of Consolidated Fund, and fees.

All sums granted by this Act, and the other Acts mentioned in Schedule A annexed hereto, out of the Consolidated Fund, amounting, as appears by the said Schedule A, to two millions three hundred and sixty-four thousand six hundred and eight pounds fifteen shillings and eightpence, together with the fees collected by such public officers as are authorized to retain the same in lieu of salary, are appropriated for the purposes and services expressed in the several votes in the Schedule B annexed hereto.

4 £100,000 out of Consolidated Fund to be transferred to Public Works Fund.

Out of the surplus moneys standing to the credit of the Consolidated Fund at the end of the financial year ending on the thirtieth day of June, one thousand eight hundred and seventy-eight, the sum of one hundred thousand pounds shall be transferred to the Public Works Fund.

5 Provision for salaries, &c., in Insurance Department.

And whereas by the thirty-ninth section of “The Government Insurance and Annuities Act,1874,” it is enacted that the salary of the Commissioner and other officers and the other contingent expenses shall be paid out of moneys from time to time appropriated from the Government Insurance Account for the purpose by the General Assembly: Be it enacted, the said salaries and expenses for the year ending the thirtieth day of June, one thousand eight hundred and seventy-nine, shall be those mentioned in the Schedule C annexed hereto.

6 Provision for salaries in Public Trust Office.

And whereas by the eleventh section of “Public Trust Office Act,1872,” it is enacted that the salary of the Public Trustee and of the other officers and servants in the Public Trust Office shall be such as shall be fixed by the General Assembly: Be it enacted that the said salaries for the year ending the thirtieth day of June, one thousand eight hundred and seventy-nine, shall be those mentioned in Schedule D annexed hereto.

7 Provision for salaries, &c., in Native Reserves Department.

The Public Trustee shall pay out of the Native Reserves Account in the Public Trust Office the several salaries and expenses set forth in the Schedule E annexed hereto.

8 Balance of votes for railway stores and workshops to be finally charged against Consolidated Fund.

The sum of one hundred and twenty-five thousand pounds, or such other sum as shall be found to be the balance of the Railway Stores and Workshops Account, created by the Appropriation Acts one thousand eight hundred and seventy-five, one thousand eight hundred and seventy-six, and one thousand eight hundred and seventy-seven, shall be finally charged against the Consolidated Fund; and all expenditure hereafter to be made in the purchase of stores, and for the cost of maintaining the workshops, shall be charged against the vote for working the railways.

9 Indemnity.

And whereas the Colonial Treasurer has, under the authority of the second section of “The Public Revenues Act,1876,” and the twelfth section of “The Public Revenues Act,1877,” issued from the Public Account, during the year ending the thirtieth day of June, one thousand eight hundred and seventy-eight, moneys in excess of or without the appropriation of Parliament, amounting in the whole to the sum of seventy-eight thousand four hundred and forty-two pounds sixteen shillings and one penny, and has applied the said sum to the several purposes and services mentioned in the Schedule F hereto annexed: Be it enacted that the application of the said sum is hereby sanctioned.

10 Moneys payable for roads in Native districts, or for works chargeable as provincial liabilities.

The moneys payable under this Act for roads in Native districts, or for works chargeable as provincial liabilities, may be paid over to such local governing bodies as the Minister for Public Works may determine, upon such terms and conditions as shall be agreed upon between the said Minister and any such local governing body; and the Colonial Treasurer shall make all such payments in accordance with any such agreement.

11 Schedules included in the Act.

The Schedules annexed hereto, with the notes, if any, to such Schedules, shall be deemed to be part of this Act, in the same manner as if they had been contained in the body hereof.
