An Act to amend “The Public Health Act, 1876.”
BE IT ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
The Short Title of this Act is “The Public Health Act 1876 Amendment Act, 1882.”
2 Amendment of section 53 of “The Public Health Act, 1876.”
Section fifty-three of “The Public Health Act, 1876,”
shall be read as if the following proviso were enacted therewith:—
Provided that where such Local Board does not, on request made to them in writing by the person or persons hereinafter mentioned in this section, make such application, then complaint or application may be made as aforesaid by any person or persons aggrieved by such foul or offensive watercourse or ditch; and thereupon the like proceedings shall be had, with the like incidents and consequences as to making orders, penalties for disobedience of orders, appeal, and otherwise as in the case of an application as aforesaid relating to foul or offensive ditches or watercourses, or a complaint relating to a nuisance, made respectively to a Resident Magistrate.
