An Act to amend, the Law relating to Duties on Gold.

BE IT ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—

1 Short Title.

The Short Title of this Act is “The Gold Duties Act Amendment Act, 1882.”.

2 When Act comes into operation.

This Act shall come into operation on the first day of November, one thousand eight hundred and eighty-two.

3 Penalty for making false statement.

Every person shall, upon purchasing gold, require the person selling the same to state the name of the county or borough of which such gold is the produce; and any person refusing to state the name of such county or borough, or knowingly making any false statement with reference thereto, shall be liable to a penalty not exceeding ten pounds.

4 Purchaser of gold to make declaration.

On and after the date when this Act shall come into operation every person purchasing gold in the Colony of New Zealand shall once in every month make and sign a declaration, under the provisions of “The Justices of the Peace Act, 1882,” or any other Act for the time being in force in New Zealand relating to declarations in lieu of oaths, stating the quantity of gold purchased by him during the preceding month, and the name of the county or counties or borough or boroughs of which such gold shall have been stated to be the produce by the seller thereof.

5 Form of declaration.

Such declaration may be in the form in the Schedule annexed to this Act, and marked “A.”

6 Declaration to be forwarded to Council. Penalty.

Immediately upon the making of any such declaration as aforesaid, the person making the same shall forward a copy of such declaration to the Clerk of the Council of the county or of the borough in which such person shall for the time being reside; and any person refusing or neglecting to forward such, copy of declaration, in manner herein provided, shall he liable to a penalty not exceeding ten pounds; and any person who shall knowingly make and subscribe any false declaration, knowing the same to be untrue in any particular, shall, in addition to any other penalty or punishment he may incur, be liable to a penalty not exceeding fifty pounds.

7 Forms to be supplied.

Forms of declaration for the purposes of this Act shall be supplied to any person requiring the same by the Commissioner of Trade and Customs.

8 Shippers of gold to produce declarations to Commissioner of Customs.

It shall be the duty of the Commissioner of Trade and Customs to require all persons passing gold for shipment to present therewith such declarations as aforesaid, showing where such gold so passed has been purchased; and such declarations shall be taken to be the basis of distribution as between the counties and boroughs.

9 Recovery of penalties.

All penalties incurred under this Act may be recovered in a summary manner, before a Resident Magistrate or any two Justices of the Peace, by any person proceeding for the recovery of such penalties.

Schedule A.

I, , of , do solemnly and sincerely declare that, between the day of and the day of now last past, I have purchased ounces of gold, and that such gold has been purchased by me, having been stated by the seller thereof to be the produce of the under-mentioned counties or boroughs—namely, the County [or Borough] of , ounces; the County [or Borough] of , ounces: And I make this solemn declaration conscientiously believing the same to be true, and by virtue of the provisions of an Act of the General Assembly of New Zealand, intituled “The Justices of the Peace Act, 1882.”

Taken and declared before me, one of Her Majesty’s Justices of the Peace in and for the Colony of New Zealand, this day of 18 .
