An Act to appropriate certain Sums of Money for the Purposes of Immigration and Public Works.
MOST GRACIOUS SOVEREIGN,—Whereas by the several Acts of the General Assembly mentioned in the First Schedule to this Act certain sums of money, amounting in the whole to the sum of twenty-one millions seven hundred thousand pounds, have been authorized to be raized by loan; and by the said Acts, and by the several Acts mentioned in the Second Schedule to this Act, various sums of the moneys so to be raised have been authorized to be issued and applied to the several works and services mentioned in the said Acts and the Schedules thereto; and various sums of money, amounting in the whole to the sum of nineteen millions and fifty-four thousand and eighteen pounds, have been so issued and applied, as in the first column of the Third Schedule to this Act set forth: And whereas it is expedient that a portion of the unexpended balance of the moneys so authorized to be raised, together with other moneys in the Fourth Schedule mentioned, should be appropriated for carrying on the said works and services:
We, Your Majesty’s most dutiful and loyal subjects, the House of Representatives of New Zealand, in Parliament assembled, have resolved to grant unto Your Majesty, towards making good the Supply which we have cheerfully granted to Your Majesty in this session of Parliament, the sums hereinafter mentioned, and do therefore most humbly beseech Your Majesty that it may be enacted, and
Be it enacted by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
The Short Title of this Act is “The Immigration and Public Works Appropriation Act, 1883.”
2 Grant of £2,091,757.
Towards defraying the expenses hereinafter mentioned the Colonial Treasurer may issue and apply any sum or sums of money not exceeding in the whole the sum of two millions and ninety-one thousand seven hundred and fifty-seven pounds out of the several Ways and Means mentioned in the Fourth Schedule to this Act.
3 Appropriation of grants.
All sums so issued shall be applied, as mentioned in the several votes set forth in the Fifth Schedule to this Act, towards defraying so much of the expenses incurred or to be incurred in the several works and services in the said Schedule mentioned as shall come in the course of payment during the year ending the thirty-first day of March, one thousand eight hundred and eighty-four, and to no other purpose whatsoever.
4 Treasurer may pay notwithstanding particular vote cannot at time of payment be determined.
Whenever it is not possible to determine at the time of payment to which particular vote mentioned in the Fifth Schedule hereto the cost of any material or other expenses should be charged, the Colonial Treasurer may notwithstanding issue and pay the same out of the several Ways and Means mentioned in the Fourth Schedule hereto: Provided that he shall from time to time carry each such payment to and charge the same against the vote on account of which such payment was made, so soon as the same can be ascertained: Provided also that all such expenditure shall be included in and shall not be in excess of the total sum hereby authorized to be issued and paid under each vote in the Fifth Schedule mentioned.
5 Nothing in Act to limit powers conferred by sections 37 or 44 of “The Public Revenues Act, 1878.”
Nothing in this Act shall limit the authority of the Colonial Treasurer to issue and pay any moneys which he may be otherwise authorized to issue and pay under the authority of the thirty-seventh or forty-fourth section of “The Public Revenues Act, 1878.”
6 Sanction of expenditure in excess of amount authorized by section 44 of “The Public Revenues Act, 1878.”
And whereas the Colonial Treasurer has, under the authority of the forty-fourth section of “The Public Revenues Act, 1878,”
issued from the Public Account, during the twelve months ended the thirty-first day of March, one thousand eight hundred and eighty-three, moneys in excess of or without the appropriation of Parliament, amounting in the whole to eight thousand one hundred and thirty-seven pounds seventeen shillings and elevenpence, and has applied the said sum to the several purposes and services mentioned in the Sixth Schedule hereto annexed: Be it enacted that the application of the said sum is hereby sanctioned.
7 Moneys appropriated for works or other purposes may be paid over to local governing bodies as Minister may determine.
The moneys appropriated by this Act for the construction of works and for other purposes may be paid over to such local governing bodies as the Minister for Public Works or other Minister may determine, upon such terms and conditions as shall be agreed upon between the said Minister for Public Works or other Minister and any such local governing body; and the Colonial Treasurer shall make all such payments in accordance with any such agreement.
8 Sums appropriated by “The Public Revenues Act, 1882,”
included in this Act.
And whereas by the ninth Section of “The Public Revenues Act, 1882,”
it is provided that all moneys issued and paid under the authority thereof shall be included in the estimates for the financial year or other period in which the same are paid, and in the accounts of such period:
Be it therefore enacted:
The several sums granted and appropriated by this Act shall be taken and deemed to be inclusive of and not in excess of the moneys issued and paid under the authority of the said ninth section of “The Public Revenues Act, 1882.”
9 Authority to Governor to enter into contracts for execution of public works for which moneys appropriated by this Act.
This Act shall be and be deemed to be a sufficient authority to the Governor, in the manner provided by “The Railways Construction Act, 1878,”
to enter into all or any contracts that may be necessary for the execution of any public work for which moneys are. Appropriated by this Act.
10 Schedules hereto to be part of Act.
The Schedules from one to seven, both inclusive, annexed hereto, with the notes, if any, to such Schedules, shall be deemed to be part of this Act, in the same manner as if they had been contained in the body hereof.
