An Act to amend “The Public Health Act, 1876.”
BE IT ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
The Short Title of this Act is “The Public Health Act 1876 Amendment Act, 1884.”
2 Further powers in restraint of offensive trades.
Every Local Board of Health constituted under “The Public Health Act, 1876,”
hereinafter referred to as “the said Act,”
shall have and may exercise the powers in restraint of offensive trades given by sections seventy-six to seventy-nine, both inclusive, of the said Act, as well as the Local Board of a city or borough, as in the aforesaid sections mentioned.
3 Nightsoil may not be deposited where it will become a nuisance.
It shall not be lawful for the Council of any borough or the Board of any town district to establish, or permit to be established, any depôt or place for the reception or deposit of nightsoil removed from any such borough or town district so as to become a public or private nuisance or a source of danger to the public health.
If any Local Board shall commit or suffer any breach of this Act, or fail to comply with the provisions thereof, any person aggrieved may cause proceedings to be taken against the corporate body which such Local Board represents in like manner as proceedings could be had or taken by a Local Board against any person under the fifty-ninth, sixtieth, and sixty-first sections of the said Act, and all other the provisions of that Act as to proceedings, the making and enforcement of orders and as to appeal therefrom, so far as applicable, shall extend and apply accordingly, and anything required to be done under the said Act by a Local Board may, for the purposes of giving effect to this enactment, be done by any such aggrieved person.
