An Act to authorize the Construction of a certain Railway, and to make Provision respecting a certain other Railway heretofore constructed.
BE IT ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
The Short Title of this Act is “The Railways Authorization and Management Act, 1886.”
2 Power for the Governor, on behalf of the Crown, to enter into contracts for railway in Schedule.
How cost to be defrayed.
The Governor may, in the name and on behalf of Her Majesty, enter into a contract or contracts for the construction of the railway mentioned in the Schedule hereto.
The cost of constructing such railway shall be borne and paid out of moneys appropriated for that purpose by the General Assembly.
3 Act to be deemed a special Act authorizing construction of railway in Schedule.
This Act shall be deemed to be a special Act authorizing the construction of the railway mentioned in the said Schedule within the meaning and for the purposes of “The Public Works Act, 1882,”
and any Act amending the same, which said Acts, so far as applicable, are hereby incorporated with this Act.
4 Branch line of railway to Oamaru Breakwater subject to “The Public Works Act, 1882.”
The branch line of railway, constructed by the Oamaru Harbour Board, from the main line of the Waitaki-Bluff Railway at Oamaru to the Oamaru Breakwater, having been purchased by the Government, is hereby declared to be a railway vested in Her Majesty the Queen within the meaning and for the purposes of “The Public Works Act, 1882,”
and its amendments, and all the provisions of such Acts, and all by-laws and regulations from time to time in force thereunder, shall apply to such railway accordingly, as if it had originally been constructed by Her Majesty.
5 Repeal
Section ten of “The Public Works Act 1876 Amendment Act, 1878,”
which authorized the Oamaru Harbour Board to construct the line of railway in the last-preceding section mentioned, is hereby repealed.
Schedule
From Kaukapakapa an extension for five miles northwards.
