An Act to appropriate certain sums of money for Public Works and Other Purposes.

MOST GRACIOUS SOVEREIGN,—Whereas under the authority of several Acts of the General Assembly certain loans have been from time to time raised for the construction of railways and other public works, and by several other Acts sums of money have been from time to time appropriated and have been in part expended as by such Acts provided, and the balance of the moneys so raised and unexpended on the thirty-first day of March in the present year amounted to the sum of seven hundred and sixty-eight thousand seven hundred and seventy-nine pounds fourteen shillings and threepence: And whereas by an Act entitled “The North Island Main Trunk Railway Loan Act, 1882,” it was provided that the Government should raise a loan not exceeding one million pounds sterling in amount for the construction of the Main Trunk Railway of the North Island, which loan has not yet been raised; and by an Act passed in the present session of Parliament entitled “The North Island Main Trunk Railway Loan Application Act, 1886,” it is provided that the moneys of the said loan shall be kept in a separate account, and shall be applied to the construction of the said railway, in such amounts and within such periods only as should be provided by any Act or Acts of the General Assembly appropriating the said moneys: And whereas by an Act passed in the present session of Parliament entitled “The New Zealand Loan Act, 1886,” it is provided that the Government may raise a loan not exceeding one million three hundred and twenty-five thousand pounds sterling in amount, and that the moneys of such loan shall be kept in a separate account, and shall be applied to the several purposes and services mentioned in the Schedule to the said Act, in such amounts and within such periods only as should be provided by any Act or Acts of the General Assembly appropriating such moneys: And whereas it is expedient that the said balance of seven hundred and sixty-eight thousand seven hundred and seventy-nine pounds fourteen shillings and threepence, together with such sums as may be transferred thereto under the operation of the ninth section of this Act, and that a portion of the said sums of one million pounds, and one million three hundred and twenty-five thousand pounds respectively, should be appropriated to the several purposes and services to which the same are applicable:

We, Your Majesty’s most dutiful and loyal subjects, the House of Representatives of New Zealand, in Parliament assembled, have resolved to grant unto Your Majesty, towards making good the Supply which we have cheerfully granted to your Majesty in this session of Parliament, the sums hereinafter mentioned, and do therefore most humbly beseech Your Majesty that it may be enacted, and

Be it enacted by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—

1 Short Title.

The Short Title of this Act is “The Public Works Appropriation Act, 1886.”

2 Grants.
Of £401,819.

The Colonial Treasurer may issue and apply—

(1.)

Out of the said balance of seven hundred and sixty-eight thousand seven hundred and seventy-nine pounds fourteen shillings and threepence, together with such sums as may be transferred thereto as aforesaid, and in addition to the sum of three hundred and sixty-eight thousand two hundred and twenty-one pounds authorized to be issued by the several Acts mentioned in Part I. of the First Schedule, any sum or sums of money not exceeding in the whole the sum of four hundred and one thousand eight hundred and nineteen pounds towards defraying the expenses of the several works and services mentioned in the Second Schedule:

Of £387,800.

(2.)

And, out of the said sum of one million pounds, any sum or sums of money not exceeding in the whole the sum of three hundred and eighty seven thousand eight hundred pounds towards defraying the expenses of the several works and services mentioned in the Third Schedule:

Of £791,000.

(3.)

And, out of the said sum of one million three hundred and twenty-five thousand pounds, any sum or sums of money not exceeding in the whole the sum of seven hundred and ninety-one thousand pounds towards defraying the expenses of the several works and services mentioned in the Fourth Schedule.

3 Appropriation of grants.

All sums so issued shall be applied as mentioned in the several votes set forth in the first column in the Second, Third, and Fourth Schedules towards defraying so much of the expenses incurred or to be incurred in the several works and services mentioned in the said Schedules as shall come in the course of payment during the year ending on the thirty-first day of March, one thousand eight hundred and eighty-seven, and to no other purposes whatsoever.

4 Amount of liabilities which may be incurred.

It shall be lawful for the Governor, in the name and on behalf of Her Majesty the Queen, to enter into any contract or contracts, or to incur any liabilities, for carrying on the works and services for which money is appropriated by this Act: Provided that the amount of liability so incurred in respect of each vote shall not, together with the sum appropriated by such vote, exceed the sum set down in the second column in the Second, Third, and Fourth Schedules opposite to each vote severally.

5 Unauthorized expenditure.

Nothing in this Act shall limit the authority of the Colonial Treasurer to issue and pay any moneys which he may be otherwise authorized to issue and pay under the authority of the forty-fourth section of “The Public Revenues Act, 1878.”

6 Indemnity.

And whereas the Colonial Treasurer has, under the authority of the forty-fourth section of “The Public Revenues Act, 1878,” issued from the Public Account, during the twelve months ended the thirty-first day of March, one thousand eight hundred and eighty-six, moneys in excess of or without the appropriation of Parliament, amounting in the whole to six thousand four hundred and sixty-five pounds seventeen shillings and fivepence, and has applied the said sum to the several purposes and services mentioned in the Fifth Schedule hereto annexed: Be it enacted that the application of the said sums is hereby sanctioned.

7 £332,161 17s. 7d expenditure under section 4 of the Immigration and Public Works Appropriation Acts sanctioned.

Whereas it has been enacted by the fourth section of the Immigration and Public Works Appropriation Acts for several past years that, whenever it was not possible to determine at the time of payment to which particular vote the cost of any material or other expenses should be charged, the Colonial Treasurer might notwithstanding issue and pay the same out of the ways and means in the schedules to such Acts mentioned: Provided that he should from time to time carry each such payment to and charge the same against the vote on account of which each such payment was made so soon as the same could be ascertained: And whereas the balance of the sums so expended, and which had not been charged against the votes as by the said Acts provided, amounted, on the thirty-first day of March last, to the sum of three hundred and thirty-two thousand one hundred and sixty-one pounds seventeen shillings and sevenpence, and it is expedient that the same should not in future be so charged, but that final authority should be given for the expenditure thereof.

Be it enacted:—

The expenditure of the said sum of three hundred and thirty-two thousand one hundred and sixty-one pounds seventeen shillings and sevenpence is hereby sanctioned.

8 Moneys may be paid over to local bodies for expenditure.

The moneys appropriated by this Act for the construction of public roads and such other public works as are usually constructed by or are under the control of local governing bodies, may be paid over to such local governing body or bodies as the Minister for Public Works or other Minister, acting on his behalf, may determine, upon such terms and conditions as shall be agreed upon between the said Minister and any such local governing body, to be expended by such body upon any of the works or services for which the same are appropriated by this Act; and the Colonial Treasurer shall make all such payments in accordance with any such agreement.

9 Moneys heretofore spent to be charged under this Act.

And whereas, in anticipation of the raising of the said loans of one million pounds and of one million three hundred and twenty-five thousand pounds respectively, moneys of loans heretofore raised have been or may be expended upon any of the works or services, mentioned in the Third or Fourth Schedules:

Be it enacted:—

All moneys so expended, or that may be expended, shall, so soon as each of the said loans shall be raised, be charged against the proper vote set forth in the Third or Fourth Schedules, as the case may be, providing for the work or service upon which such moneys shall have been expended.

10 Schedules to be a part of this Act.

The Schedules from one to six, both inclusive, annexed hereto, with the notes, if any, to such Schedules, shall be deemed to be part of this Act, in the same manner as if they had been contained in the body hereof.
