An Act to amend “The North Island Main Trunk Railway Loan Application Act, 1886.”
BE IT ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
The Short Title of this Act is “The North Island Main Trunk Railway Loan Application Act Amendment Act, 1889.”
2 Additional sum of £120,285 allocated for land purchases.
Subsection five of section four of “The North Island Main Trunk Railway Loan Application Act, 1886”
(hereinafter referred to as “the said Act”
), and all other provisions of the said Act, with the exception of the provisions contained in section five thereof, shall be read and construed as if the words “two hundred and twenty thousand two hundred and eighty-five pounds”
had been originally inserted in place of the words “one hundred thousand pounds”
where they occur in the said subsection.
3 How additional sum is to be applied.
The additional sum of one hundred and twenty thousand two hundred and eighty-five pounds thus allocated for land purchases shall be applied as follows:—
(1.)
The sum of twenty thousand two hundred and eighty-five pounds shall be paid as a refund to Part I. of the Public Works Fund for lands purchased and leased out of that fund within the North Island Trunk Railway area, as described in the First Schedule hereto.
(2.)
The sum of one hundred thousand pounds shall be applied in completing land purchases at present incomplete, and making further land purchases within the portions of the North Island Trunk Railway area described in the Second Schedule hereto.
4 How land and proceeds thereof shall be disposed of.
The fifth section of the said Act is hereby repealed, and in lieu thereof it is hereby enacted:—
(1.)
Out of the land acquired or that may be acquired under the provisions of subsection five of the fourth section of the said Act at least five per centum of such lands shall be from time to time reserved and set apart, at such times and in such blocks as the Governor directs, as an endowment for the maintenance of primary education within the education district in which such land is situated, and such land shall be subject to and may be dealt with by School Commissioners appointed under “The Education Reserves Act, 1877,”
and its amendments.
(2.)
The remainder of such land so acquired or that may be acquired as aforesaid shall constitute an endowment for the purposes of the North Island Main Trunk Railway, and may from time to time be sold, leased, or otherwise alienated or disposed of under and in accordance with the provisions of “The Land Act, 1885,”
and its amendments, and all the proceeds thereof (after payment of all expenses necessary for carrying out any such sale, lease, alienation, or disposition) shall be paid into the separate account mentioned in the third section of the said Act, and shall be applied thereout as the General Assembly shall direct from time to time in the construction of the said Main Trunk Railway and of branch railways, tramways, and roads thereto or in connection therewith.
(3.)
This enactment shall be deemed to have been in operation as from the passing of the said Act; and any sale, lease, or other alienation of the land mentioned in the said fifth section heretofore made under “The Land Act, 1885,”
or its amendments, and all acts, instruments, and proceedings heretofore done, signed, or executed in respect thereof or in relation thereto, shall be deemed to have been made, done, signed, or executed under the powers herein contained, and to be valid and effectual for all purposes accordingly.
(4.)
No person or body shall have any right or claim to the proceeds of the sale, lease, or other alienation or disposition of the lands acquired or to be acquired as aforesaid, otherwise than as herein specially provided.
5 Application of “The Native Lands Frauds Prevention Act 1881 Amendment Act, 1888.”
All the land included in the description contained in the Second Schedule of this Act shall, for two years commencing from the first day of January, one thousand eight hundred and ninety, be deemed and held to be Native land as defined in the second clause of “The Native Lands Frauds Prevention Act 1881 Amendment Act, 1888,”
and the said Act, so far as the same relates to Native land, shall be held and deemed to apply to and affect all the land in the said Schedule, notwithstanding that the same may be held under Crown grant or certificate of title:
Provided that nothing in this section shall affect or apply to the Crown, or to any person acting for or on behalf of the Crown, under the authority or by the direction of a Minister of the Crown.

SECOND SCHEDULE
Portions of the North Island Trunk Railway Area within which the Land Purchases at present incomplete are to be completed, and further Purchases effected out of the additional £100,000 herein allocated for Land Purchases.
All that area in the Provincial District of Auckland bounded towards the northeast by the Parish of Pirongia to the Puniu River; thence by that river and the Owairaka Stream to the source of the latter; thence by a right line to the confluence of the Mangere Stream with the Waikato River; thence by the said Waikato River to the Mangarewa Stream; thence towards the south-east generally by a right line to Trigonometrical Station Wharepuhanga; thence by a right line to To Ranga Mountain; thence by a right line to Trigonometrical Station Ranginui; thence by a right line to the source of the Mokau River; thence by the Mokau River to the Mangaotaki River; thence towards the west by a right line to Trigonometrical Station Hauturu; thence by the summit of the range to the Pirongia Block; thence by the said Pirongia Block to its north-eastern corner; and thence by Native land to the Parish of Pirongia aforesaid.
Also all that area in the Provincial Districts of Auckland and Wellington bounded towards the north-east by the Wanganui River, the Mangatepopo River, the Huimako River, and the Wairehu River, from Whakapapa River to Roto Aira; thence by Roto Aira and the Poutu River to the Waikato River; thence towards the east and north by the said Waikato River, the south-east boundary of the Rangipo North Block No. 7, the northern boundary-line of Rangipo-Waiau Block No. 1, and the northern and eastern boundaries of the Rangipo-Waiau Block No. 2, the eastern boundary of the Rangipo-Waiau Block, and the northern boundary of the Awarua Block to the Ruahine Range; again towards the east by the summit of the Ruahine Range; towards the south by the southern boundary-line of the said Awarua Block, by the southern boundaries of Te Kapua and Pohonuitane Blocks to the Maungakaretu Block; thence towards the west and again towards the south and east by the Maungakaretu Blocks Nos. 4a, 6, 5a, 3a, and 2; again towards the south by the Heao, Paratickc, Ohinciti, Karewarewa, and To Kahakaha Blocks respectively to the Wanganui River; thence to the south west generally by that river to the Oao Stream; thence towards the north-west generally by the northern boundary of the Ohoutahi Block, the southern boundary of the Ötarangoho Block, and the northwestern boundary of the Mangoihe Block to the Atuahae Block; thence by the last-mentioned block, the Waimarino Block, the Raetihi Block No. 1, the Tawhito-Ariki Block, the Rangataua Blocks North No. 1 and South, and the Raetihi Blocks to the said Waimarino Block; thence by that block and the Ruapehu Blocks Nos. 2a and 1a; and again towards the south-west generally by the said Waimarino Block to the Taurewa Block; thence by that block and the Waimarino Block aforesaid to the place of commencement: excepting, nevertheless, all lands already purchased by the Crown.
