An Act to amend “The Administration Act 1879 Amendment Act, 1885,”
and 1888.
BE IT ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
The Short Title of this Act is “The Administration Acts Amendment Act, 1890.”
2 Interpretation.
“The Administration Act 1879 Amendment Act, 1885,”
shall be read and construed as if the word “separate,”
wherever it occurs before the word “property,”
had been omitted therefrom.
3 Application of Act to deceased married women’s estates.
The provisions of this Act shall extend and apply to the estates remaining unadministered of all married women who have died after the coming into operation of “The Married Women’s Property Act, 1884.”
4 Proviso to section 18 of Amendment Act, 1888, repealed.
The proviso to the eighteenth section of “The Administration Act 1879 Amendment Act, 1888,”
is hereby repealed, and in lieu thereof the following provision shall be deemed to have been in force from the date of the passing of the said Act:—
Provided that the power of sale hereby conferred shall not be exercised without the leave of the Supreme Court or a Judge thereof, but such consent shall not be necessary when the sale is made by the executor or administrator of any deceased person in furtherance or in exercise of any duty or power imposed or conferred upon or vested in him by the seventh section of “The Administration Act, 1879.”
