An Act to authorise the Construction of Extensions of, and Additions to, certain Railways, and also to provide for the Management, Working, and Maintenance of the Kaihu Valley Railway, and for other Purposes.
Preamble.
WHEREAS it is expedient to provide for the construction of extensions of, and additions to, the lines of railway mentioned in the First Schedule to this Act: And whereas the estate and interest in the land described in the Second Schedule hereto, whereon is constructed the line of railway known as the Kaihu Valley Railway, together with the buildings and wharf thereon, and certain permanent-way, rolling-stock, plant, goods, and chattels used upon or in connection with the said railway (all of which land, buildings, wharf, permanent-way, rolling-stock, plant, goods, and chattels are hereinafter included in the expression “the Kaihu Valley Railway”
), hath lately been purchased or otherwise acquired by or on behalf of Her Majesty the Queen, and is now vested in Her said Majesty, and it is expedient provision should be made for the future management, working, and maintenance of the said railway:
Be it therefore enacted by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
The Short Title of this Act is “The Railways Authorisation and Management Act, 1891.”
2 Power for the Governor to enter into contracts for extension of certain railways.
The Governor may, in the name and on behalf of Her Majesty, enter into a contract or contracts for the construction of extensions of, and additions to, the railways mentioned or referred to in the First Schedule to this Act.
How cost to be defrayed.
The cost of constructing such extensions and additions shall be borne and paid out of moneys appropriated for that purpose by the General Assembly.
3 Act to be deemed a special Act authorising construction of extensions.
This Act shall be deemed to be a special Act authorising the construction of such extensions of, and additions to, the said railways within the meaning and for the purposes of “The Public Works Act, 1882,”
and any Act amending the same, which said Acts, so far as applicable, are hereby incorporated with this Act; and any of such extensions or additions which are wholly or partially made shall be deemed to have been made and may be finished under the authority of this Act.
4 Kaihu Valley Rail way may be worked, &c., under “The Public Works Act, 1882.”
The Kaihu Valley Railway hereinbefore mentioned shall be and be deemed, from the date of the purchase or acquisition thereof by Her Majesty, to have been a railway constructed under the authority of a special Act, and shall be and be deemed to have been, from the date of such purchase or acquisition as aforesaid, managed, worked, and maintained by the Minister for Public Works under and subject to the provisions of “The Public Works Act, 1882,”
and its amendments.
Receipts and expenditure.
All revenues or other moneys derived from the management and working of the said railway shall be paid into the credit of the Public Works Fund, and all costs and charges of the management, working, and maintenance of the railway shall be defrayed out of such moneys as shall from time to time be appropriated for that purpose by the General Assembly.
Certain rights reserved.
Nothing in this Act contained shall prejudice or affect the rights or remedies of the Kaihu Valley Railway Company (Limited), or the liquidators thereof, to the rolling-stock, plant, goods, and chattels referred to in the said preamble, or to any compensation or right of action of such company or liquidators in respect of such premises or any part thereof.
5 Power to vest Kaihu Valley Railway in the New Zealand Railway Commissioners.
The Governor in Council may declare the Kaihu Valley Rail way to be vested in the New Zealand Railway Commissioners appointed under “The Government Railways Act, 1887,”
and thereupon the said railway shall vest in and be managed, worked, and maintained by such Commissioners under and subject to the provisions of the said Act, as if it had been a railway constructed by or on behalf of Her Majesty.
6 Wharf at Mount Rix vested in the New Zealand Rail way Commissioners.
The wharf erected at Mount Rix, together with the land on which the same is erected, and all rights and appurtenances thereto, which is and are now vested in Her Majesty the Queen, shall hence forth be vested in the New Zealand Railway Commissioners, and shall be held, used, and maintained by them as part of the Kaipara-Waikato Railway now vested in the said Commissioners under “The Government Railways Act, 1887.”

FIRST SCHEDULE

| 4. Otago Central (Wingatui Ballast-pit Siding) | A siding from the Otago Central Railway, about 2 miles 18½ chains from its junction with the Waitaki-Bluff Railway, to the ballast-pit in Sections 6 and 5, Block XIV., Taieri Survey District. Length about 85 chains. |
SECOND SCHEDULE
All that portion of land (including the railway-wharf at Dargaville) containing by admeasurement 185 acres, more or less, extending from the northern bank of the Wairoa River in a north-westerly direction for a distance of about 19 miles 20 chains, situated in Block XIII., Manngaru Survey District, Dargaville Township; Blocks XV., XII., XI., VII., VT., and II., Kaihu Survey District; and Blocks XIV. and XIII., Tutamoe Survey District; all in the Counties of Hobson and Hokianga and Provincial District of Auckland; as the same is delineated on Plan P.W.D. 16829, deposited in the office of the Minister for Public Works at Wellington, and thereon coloured or edged red, purple, green, and yellow. Together, also, with all the buildings and erections thereon, and all the rights and appurtenances to the said land, wharf, buildings, or erections belonging or appertaining.
