An Act to authorise an Exchange of Part of the Auckland University College Endowment Land for Crown Lands.
Preamble.
WHEREAS the land described in the First Schedule hereto forms part of the endowment land which, by “The Auckland University College Reserves Act, 1885,”
was vested in the Auckland University College Council incorporated under “The Auckland University College Act, 1882,”
and a certificate of title dated the first day of January, one thousand eight hundred and eighty-six, was issued to the aforesaid Council for the said land:
And whereas Her Majesty the Queen, being desirous to set apart the aforesaid land as a reserve for public utility, agreed with the Council aforesaid to exchange the said land for other lands described respectively in the Second Schedule hereto, which are Crown lands vested in Her Majesty:
And whereas the Auckland University College Council agreed to the terms of the proposed exchange, and, in supposition that they had due authority of law in that behalf, did on the eighteenth day of September, one thousand eight hundred and ninety-one, execute a memorandum of transfer under their corporate seal and the hand of Sir George Maurice O’Rorke, as Chairman of the said Council, transferring the land described in the First Schedule to Her Majesty in fee-simple:
And whereas there was no authority of law to sanction the aforesaid transfer, but it is expedient to validate the same, and to authorise Her Majesty, in fulfilment of the recited agreement, to grant the lands described in the Second Schedule to the aforesaid Council in equality of exchange:
Be it therefore enacted by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
The Short Title of this Act is “The Auckland University College Land Exchange Act, 1892.”
2 Transfer of land to Her Majesty from Auckland University College validated.
The memorandum of transfer dated the eighteenth day of September, one thousand eight hundred and ninety-one, under the corporate seal of the abovementioned Auckland University College Council, and the signature of Sir George Maurice O’Rorke, Chairman of such Council, transferring to Her Majesty the estate of the Council in the land described in the First Schedule hereto, is hereby validated, and shall be deemed to have been valid from the date of the execution thereof; and from such date the said land shall be deemed to have been vested in Her Majesty discharged from all reservation as an university endowment, and shall be deemed to be a reserve for public utility under Class II. within the meaning of “The Public Reserves Act, 1881.”
3 Governor may grant other lands to college in exchange.
The Governor, in the name and on behalf of Her Majesty, may, in equality of exchange for the lands herein last previously mentioned, grant the lands respectively described in the Second Schedule hereto to the Auckland University College Council, to be held by them for the same purposes and on the same trusts as the lands described in the Schedule to “The Auckland University College Reserves Act, 1885,”
are held by the aforesaid Council.
SCHEDULES
FIRST SCHEDULE Lands to be vested in Her Majesty
All that piece of land situated in the Land District of Auckland, containing by admeasurement 20 acres 3 roods 7 perches, be the same a little more or less, being a portion of Section No. 245, Parish of Waimana, Whakatane County, included in certificate of title, Vol. lvi., folio 284, and commencing at a point on the eastern boundary of original Section No. 27, at a distance of 146.2 links from its northern angle. Bounded towards the east by a line, 1971·4 links; towards the south by a line, 2110·4 links; and towards the north-west by a line, 2888 links, to the commencing-point: be all the aforesaid linkages more or less; as the same is delineated on map No. 476, deposited in the Survey Office at Auckland.
SECOND SCHEDULE Lands to be granted to Auckland University College
Section 17a, Parish of Waimana, Whakatane County
All that parcel of land in the Land District of Auckland, containing by admeasurement 50 acres, more or less, being Section No. 17a, Parish of Waimana, in Whakatane County. Bounded towards the north-west, north-east, and south-east by Section No. 245, University Endowment; and towards the south-west by a public road.
Section No. 75, Parish of Karamu, Raglan County
All that parcel of land in the Land District of Auckland, being Section No. 75, Parish of Karamu, Raglan County, and containing by admeasurement 250 acres, more or less. Bounded towards the north-east by Section No. 174, Parish of Karamu aforesaid, 9880 links; towards the south-east generally by a public road, 520 links, 616 links, 340 links, 726 links, 558 links, 353 links, 320 links, 2091 links, 484 links, 557 links, 592 links, 413 links, 404 links, 440 links, 1070 links, 415 links, 344 links, 280 links, 853 links, 376 links, 413 links, 171 Links, 406 links, 230 links; and towards the north-west by Section No. 174, Parish of Karamu aforesaid, 4670 links: be all the aforesaid linkages more or less.
