An Act to authorise the Sale of Crown. Lands in the Borough of Napier heretofore used for Native Purposes.
Preamble.
WHEREAS certain lands in the Borough of Napier, described in—
(1.)
Certificate of title, Register-book, Hawke’s Bay, volume four, folio two hundred and ninety, six perches and two square yards or thereabouts, part of Town Section three hundred and six, Town of Napier, dated the twentieth day of June, one thousand eight hundred and seventy-six; and,
(2.)
Certificate of title, Register-book, Hawke’s Bay, volume four, folio two hundred and ninety-one, eighteen perches and five and a half square yards or thereabouts, portion of Town Section three hundred and six, Town of Napier, also dated the twentieth day of June, one thousand eight hundred and seventy-six,—
were transferred in fee-simple to Charles Heaphy, of Wellington, Commissioner of Native Reserves, who, by a deed of declaration of trusts dated the second day of November, one thousand eight hundred and seventy-six, declared that he held the said lands in trust for Her Majesty the Queen and her successors; and, the said Charles Heaphy being now dead, it is necessary to declare how the said lands shall be vested:
And whereas the aforesaid lands were purchased on behalf of Her said Majesty out of moneys appropriated for Native purposes by “The Civil List Act, 1863,” and were utilised for affording accommodation of Natives visiting the Town of Napier, and, being no longer required for such purpose, it was deemed advisable to sell the said lands:
And whereas on the seventh day of October, one thousand eight hundred and eighty-nine, the said lands were offered at public auction, and parts thereof were sold, but the sales could not be completed for want of due authority of law to make such sales; and it is expedient to confirm the said sales, and to authorise the sale of all unsold portions of such lands, and to authorise the granting of a valid title thereto:
Be it therefore enacted by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
The Short Title of this Act is “The Napier Native Hostelry Site Sale Act, 1892.”
2 Napier Native Hostelry vested in Her Majesty.
The lands described in the above-recited certificates of titles are hereby declared to be vested for an estate in fee-simple absolutely in Her Majesty and her successors.
3 Power to sell. Former sales confirmed.
The Governor, on behalf of Her Majesty, may direct all or any unsold portions of the said lands, as he shall think fit, to be sold by public auction from time to time; and all sales at auction of any portion of the said lands as hereinbefore recited arc hereby confirmed on behalf of Her Majesty and validated.
4 Application of funds.
The proceeds of every such sale, less the expenses attending the sale, shall be paid into the Public Account to the credit of that portion of the Civil List Fund which is appropriated to Native purposes, and shall be applied to the purchase of another site in the District of Hawke’s Bay, to be utilised in the same manner as aforesaid.
5 District Land Registrar may give title.
The District Land Registrar of Hawke’s Bay is hereby authorised to transfer any of the lands sold as aforesaid to the purchasers thereof, notwithstanding the death of the above-mentioned Charles Heaphy, and for so doing this Act shall be sufficient warrant.
