An Act for the Protection of the Submarine Telegraph Cables lying in or in the Vicinity of Lyall Bay, in Cook Strait.

Preamble.

WHEREAS by section six, subsection one (a), of “The Wellington City Sanitation Loan Empowering Act, 1892” (hereinafter referred to as “the said Act”), it is provided, amongst other things, that the Wellington City Council may provide an efficient system of drainage for the city, whereby the sewage and drainage of the city will be conveyed and discharged into the sea in Cook Strait, or be otherwise dealt with as in the said Act mentioned:

And whereas the submarine telegraph cables in Lyall Bay, in Cook Strait, may be injured by the discharge of the said sewage and drainage into or in the vicinity of the said bay: For the protection of the said cables—

Be it therefore enacted by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—

1 Short Title.

The Short Title of this Act is “The Submarine Telegraph Cables Protection Act, 1893.”

2 Wellington Corporation to be liable for damage to cables by discharge of sewage into or near Lyall Bay.

Notwithstanding anything contained in the said Act, the Corporation of the City of Wellington shall be liable to Her Majesty the Queen for all damage which may at any time be proved to be done to any submarine telegraph cable now lying in Lyall Bay, in Cook Strait, or which may hereafter be laid in the said bay by or on behalf of Her Majesty, by, through, or in consequence of the discharge of the sewage and drainage of the City of Wellington into or in the vicinity of the said bay.

And the amount of such damage, together with the cost of raising, repairing, or renewing and replacing any such cable as aforesaid, may be recovered from the said Corporation as a debt due to the Queen.
