An Act to amend “The Payment of Members Act, 1892.”
BE IT ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
The Short Title of this Act is “The Payment of Members Act Amendment Act, 1893.”
2 Amendments of principal Act.
“The Payment of Members Act, 1892”
(herein referred to as “the said Act”
), shall be read and take effect, after the passing of this Act, with the following omissions and substitutions therein, that is to say:—
(1.)
In section four, the second paragraph shall be omitted, and the following substituted in lieu thereof:—
And such payment shall be payable out of the Consolidated Fund by equal monthly payments on the last day of each and every month in each year to every such member: if a member of the Legislative Council, from the time of his appointment thereto by the Governor until his seat becomes vacant by death or the effluxion of the time of his appointment, as the case may be, or otherwise in any manner; or, if a member of the House of Representatives, from the date of the return of the writ of his election, until his seat becomes vacant by death, or otherwise in any manner, or until the expiry by effluxion of time or the dissolution of the Parliament for which he was elected, as the case may be.
(2.)
Subsections one and two of section five are hereby repealed, and the following substituted in lieu hereof:—
(a.)
If during any session any member shall absent himself for any number of sitting-days exceeding five, there shall be deducted from the payment to be made to such member for every sitting-day (exclusive of such five sitting-days) during which he may be absent the sum of one pound and five shillings in the case of a member of the Legislative Council, and the sum of two pounds in the case of a member of the House of Representatives.
The exemption from penalty in respect of absence for five sitting-days during any session shall be reckoned from the commencement of such session, and allowed accordingly, after which all deductions in respect of the absence of a member shall be made from the monthly payments to be made from time to time to such member after the occurrence of such absence.
(b.)
The preceding provision as to the deduction to be made in the case of absence of any member shall not apply where such absence is caused by reason of illness, or from any other cause which shall, by the Speaker of the Council or House giving the certificate in section seven of the said Act mentioned, be therein stated to be unavoidable.
(3.)
In section six, the words “in respect of any session or in respect of any part of any session during which such member,”
shall be omitted, and the following substituted in lieu thereof: “in respect of any period during which such member.”
