An Act to authorise the Closing and Abandonment of the Taonui Branch Railway.

Preamble.

WHEREAS in the month of June, in the year one thousand eight hundred and seventy-nine, a branch line of railway was completed from the main line of railway between Wanganui and Foxton, commencing at a point near the Taonui siding of the main line, and passing along the road thence for a distance of about one hundred and fifty-five chains to the road boundary of a Government land reserve whereon there was a valuable totara forest:

And whereas, the totara trees in the said forest being now all felled, and the purpose of the above-mentioned branch line attained, it is expedient to close and abandon the same as no longer necessary:

Be it therefore enacted by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—

1 Short Title.

The Short Title of this Act is “The Taonui Branch Railway Act, 1894.”

2 Governor may declare branch railway closed for traffic, and may sell materials thereof and land.

The Governor may, by notification in the Gazette, declare the Taonui branch line of railway, described in the recitals hereto, to be closed for public traffic, and may order the rails and other materials thereof to be removed, and, together with the rolling-stock thereof, to be sold or otherwise disposed of as he shall think best for the public service.

He also may sell or otherwise dispose of in similar manner the land forming part of the said branch line of railway, except where the same is part of a public road.

All proceeds of any such sale as aforesaid shall be paid into the Public Works Fund.
