Contents
An Act to appropriate certain Sums of Money for Public Works and other Purposes.
MOST GRACIOUS SOVEREIGN,—Whereas under the authority of several Acts in that behalf certain unexpended balances of loans raised or to be raised were, upon the thirty-first day of March, in the present year, standing to the credit of the two Parts of the Public Works Fund, particularly described in section seven of “The Public Revenues Act, 1891,”
that is to say: to the credit of Part I., two hundred and sixty-eight thousand five hundred and twenty-five pounds; to the credit of Part II., twenty-six thousand six hundred and four pounds: And whereas it is expedient that a portion of such sums severally, and of such other moneys as may become payable into the Public Works Fund, should be appropriated to the several purposes and services to which the same are applicable:
We, Your Majesty’s most dutiful and loyal subjects, the House of Representatives of New Zealand, in Parliament assembled, have resolved to grant unto Your Majesty, towards making good the Supply which we have cheerfully granted to Your Majesty in this session of Parliament, the sums hereinafter mentioned, and do therefore most humbly beseech Your Majesty that it may be enacted, and
Be it enacted by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
The Short Title of this Act is “The Public Works Appropriation Act, 1895.”
2 Grants. Of £209,504.
The Colonial Treasurer may issue and apply—
(1.)
Out of the said balance standing to the credit of Part I., amounting to the sum of two hundred and sixty-eight thousand five hundred and twenty-five pounds, and of such other moneys as may become payable into Part I. of the Public Works Fund, and in addition to the sum of two hundred and thirty thousand seven hundred and nineteen pounds authorised to be issued by the several Acts mentioned in the first part of the First Schedule hereto, any sum or sums of money not exceeding in the whole the sum of two hundred and nine thousand five hundred and four pounds towards defraying the expenses of the several works and services mentioned in the Second Schedule:
Of £31,760.

And, out of the said balance of twenty-six thousand six hundred and four pounds standing to the credit of Part II., and in addition to the sum of five thousand and forty pounds authorised to be issued by the Acts mentioned in the second part of the First Schedule hereto, any sum or sums of money not exceeding in the whole the sum of thirty-one thousand seven hundred and sixty pounds towards defraying the expenses of the several works and services mentioned in the Third Schedule.
3 Lands Improvement Account: grant of £166,582.
And whereas by Part I. of “The Lands Improvement and Native Lands Acquisition Act, 1894,”
it is enacted that the payment of the sums for which money is appropriated by Parliament for the purposes of that Part of that Act is to be made out of moneys credited to a separate account called “The Lands Improvement Account”
: Be it enacted that out of such moneys any sum or sums not exceeding in the whole the sum of one hundred and sixty-six thousand five hundred and eighty-two pounds shall be used towards defraying the expenses of the several works and services mentioned in the Fourth Schedule.
4 Native Lands Purchase Account: grant of £148,991.
And whereas by Part II. of “The Lands Improvement and Native Lands Acquisition Act, 1894,”
it is enacted that the payment of the sums for which money is appropriated by Parliament for the. purposes of that Act is to be made out of moneys credited to a separate account called “The Native Lands Purchase Account”
: Be it enacted that out of such moneys any sum or sums not exceeding in the whole the sum of one hundred and forty-eight thousand nine hundred and ninety-one pounds shall be used towards defraying the expenses of the several works and. services mentioned in the Fifth Schedule.
5 Appropriation of grants.
All sums so issued shall be applied for the purposes and services expressed in the several votes set forth in the Second, Third, Fourth, and Fifth Schedules annexed hereto as shall come in the course of payment during the year ending on the thirty-first day of March, one thousand eight hundred and ninety-six, and to no other purposes whatsoever.
6 Amount of liabilities which may be incurred.
It shall be lawful for the Governor, in the name and on behalf of Her Majesty the Queen, to enter into any contract or contracts, or to incur any liabilities, for carrying on the works and services for which money is appropriated by this Act: Provided that the amount of liability so incurred in respect of such vote shall not, together with the sum appropriated by such vote, exceed the sum set down in the ninth column in the Seventh Schedule opposite to each railway or other work for which money is appropriated by this Act.
7 Appropriations continued for three months.
The Colonial Treasurer may, during the three months ending the thirtieth day of June, one thousand eight hundred and ninety-six, issue and pay moneys out of the unexpended balances of votes set forth in the Second Schedule hereto, together with an amount equal to one-fourth part of each such vote; but no payment shall be made during such period for any services other than those for which provision is made in the appropriations for the current year, nor in excess of the scale therein set forth.
8 Unauthorised expenditure.
Nothing in this Act shall limit the authority of the Colonial Treasurer to issue and pay any moneys which he may be otherwise authorised to issue and pay under the authority of the forty-eighth section of “The Public Revenues Act, 1891.”
9 Indemnity.
And. whereas the Colonial Treasurer has, under the authority of the forty-eighth section of “The Public Revenues Act, 1891,”
issued from the Public Account, during the twelve months ended the thirty-first day of March, one thousand eight hundred and ninety-five, moneys in excess of or without the appropriation of Parliament, amounting in the whole to three hundred and thirty pounds eight shillings and one penny, and has applied the said sum to the several purposes and services mentioned in the Sixth Schedule hereto annexed: Be it enacted that the application of the said sums is hereby sanctioned.
10 Moneys may be paid over to local bodies for expenditure.
The moneys appropriated by this Act for the construction of public roads and such other public works as are usually constructed by or are under the control of local governing bodies may be paid over to such local governing body or bodies as the Minister for Public Works or other Minister acting on his behalf may determine, upon such terms and conditions as shall be agreed upon between the said Minister and any such local governing body, to be expended by such body upon any of the works or services for which the same are appropriated by this Act; and the Colonial Treasurer shall make all such payments in accordance with any such agreement.
