An Act to amend “The Abattoirs and Slaughterhouses Act Amendment Act, 1895.”
BE IT ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
The Short Title of this Act is “The Abattoirs and Slaughterhouses Act Amendment Act, 1896.”
2 No liability if drainage does not pollute stream.
(1.)
In any proceedings against any person for permitting or suffering drainage to flow from any abattoirs or slaughterhouse into any stream running through the Borough of Green Island, it shall be a sufficient defence if he satisfies the Court that the stream is not thereby polluted.
(2.)
Section five of “The Abattoirs and Slaughterhouses Act Amendment Act, 1895,”
shall be read subject to this section.
3 Section 51 of “The Abattoirs and Slaughterhouses Act, 1894,”
amended.
(1.)
Nothing contained in “The Abattoirs and Slaughterhouses Act, 1894,”
or any amendment thereof, shall apply to any bonâ fide farmer who, as incident to his farming operations, slaughters on his farm for sale or barter not more than one head of large or five head of small cattle in any one week: Provided that the rights conferred by this section shall not apply to any of the following cases, that is to say,—
(a.)
If the cattle are sold or bartered anywhere to a butcher; or
(b.)
If the cattle are sold or bartered to any other person anywhere inside of a city, borough, or town district, or within five miles of the nearest boundary thereof; or
(c.)
If the farm is situate inside a city, borough, or town district, or within five miles of the nearest boundary thereof;
(d.)
Unless the farmer so slaughtering the large or small cattle shall keep a record of the cattle so slaughtered, sold, and bartered; and such record shall be open to inspection by any authorised Inspector.
(2.)
Section fifty-one of “The Abattoirs and Slaughterhouses Act, 1894,”
is hereby amended in so far as it conflicts with this section.
