An Act to give Effect to certain Arrangements made with the Borough of Balclutha relating to Land taken for the Purposes of the Waitaki-Bluff Railway.
Preamble.
WHEREAS by Proclamation under “The Public Works Act, 1894,”
dated the eighteenth day of September, one thousand eight hundred and ninety-five, and gazetted on the nineteenth day of September, one thousand eight hundred and ninety-five, the land specified in the Schedule hereto was (with other land) taken and vested in Her Majesty for the purposes of the Waitaki—Bluff Railway: And whereas difficulties have arisen as to the compensation payable in respect thereof, and otherwise, and, in order to remove such difficulties, the arrangement hereinafter appearing has been made between the Corporation of the Mayor, Councillors, and Burgesses of the Borough of Balclutha, as claimants, and Her Majesty: And whereas it is expedient to give effect to such arrangement:
Be it therefore enacted by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
The Short Title of this Act is “The Railways Compensation Adjustment Act, 1896.”
2 Payment of compensation to Balclutha Corporation authorised.
The sum of two hundred and fifty pounds shall, without further appropriation, be payable to the Corporation of the Mayor, Councillors, and Burgesses of the Borough of Balclutha out of the Public Works Fund, in full satisfaction of all claims for compensation or otherwise in respect of the land described in the Schedule hereto.
3 Land to revest in Corporation on 19th September, 1899.
On the nineteenth day of September, one thousand eight hundred and ninety-nine, the said land shall, without the execution of any instrument, revest in the said Corporation for the same estate and interest as it possessed therein immediately prior to the date upon which it was taken by Proclamation as aforesaid; and the District Land Registrar shall, on the application of the said Corporation, and without cost, make all entries and do all acts necessary in order to register the said Corporation as the proprietor thereof accordingly.
Schedule
All that parcel of land situate in the Clutha Survey District, containing 7 acres 2 roods 1 perch, more or less, being part of Section 2, Block XXXV., on the map of that district: as the same is delineated on the plan marked P.W.D. 17530, deposited in the office of the Minister for Public Works, at Wellington, and thereon coloured neutral tint.
