An Act to amend “The Explosives Act, 1882.”
BE IT ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
The Short Title of this Act is “The Explosives Act Amendment Act, 1897,”
and it shall form part of and be read together with “The Explosives Act, 1882”
(hereinafter called “the principal Act”
).
2 Minister of Defence to administer Act.
(1.)
Section two of the principal Act is hereby amended by repealing the definition of “Commissioner,”
and inserting the following in lieu thereof:—
“‘Minister’ means the Minister of Defence, or such other Minister, being a member of the Executive Council of the colony, as from time to time may be appointed by the Governor to have charge of the administration of this Act.”
(2.)
The word “Minister”
is hereby substituted in lieu of the word “Commissioner”
wherever the latter word occurs in the principal Act.
3 The Governor may make regulations.
The Governor may from time to time, by Order in Council gazetted, make such regulations as he deems necessary for all or any of the following purposes, that is to say,—
(1.)
To regulate the importation of explosives into New Zealand;
(2.)
To prevent and prohibit the importation into New Zealand, or the manufacture, storage, transport, or sale in New Zealand, of explosives which, by reason of their composition, quality, grade, or character, are in his opinion too dangerous for use;
(3.)
To condemn all such explosives as last aforesaid, and provide for the destruction or other disposal thereof;
(4.)
To provide for the inspection and testing of explosives;
(5.)
Such other purposes as he deems expedient in the interests of the public safety;
(6.)
To impose penalties, in no case exceeding fifty pounds, for the breach of any regulation made under this section.
