An Act to amend “The First Offenders’ Probation Act, 1886.”
BE IT ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
The Short Title of this Act is “The First Offenders’ Probation Act Amendment Act, 1898.”
2 Probation Officer to state fully grounds of refusal to recommend offender for probation. Court may make known to offender grounds on which refusal based. Court may take evidence on matters stated in report.
Whenever a Probation Officer does not recommend to the Court, under section seven of the said Act, that the best interests of the public and the offender would be subserved by placing him upon probation under the said Act, such Probation Officer shall state to the Court fully and in writing the grounds upon which he refuses to make such recommendation; and the Court may in its discretion make known to the offender the grounds of such refusal, and may receive such evidence, in open Court or otherwise, as the Court shall think fit to admit as to the truth or otherwise of any matter stated in the Probation Officer’s report.
