An Act to amend “The Kauri-gum Industry Act, 1898.”
BE IT ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
The Short Title of this Act is “The Kauri-gum Industry Amendment Act, 1902”
; and it shall form part of and be read together with “The Kauri-gum Industry Act, 1898”
(hereinafter referred to as “the principal Act”
).
2 Gum-digging in State forests.
(1.)
Notwithstanding anything in the principal Act, the Commissioner of Crown Lands may, with the consent of the Commissioner of State Forests, issue licenses under the principal Act for digging gum on land subject to “The New Zealand State Forests Act, 1885,”
during the period from the first day of May to the thirtieth day of September in each year.
(2.)
A fee of ten shillings shall be payable in respect of every such license, which fee shall be paid into the State Forests Account.
3 Reserve when worked out to be dealt with by Land Board.
Where any land set apart under the principal Act as a kauri- gum reserve is no longer required for the purpose of gum-digging, the Governor may, by Order in Council gazetted, declare that such land is no longer subject to the principal Act, and shall thereafter be dealt with by the Land Board as ordinary Crown land:
Provided that such Order shall only be issued in pursuance of a resolution of the Land Board, supported by such independent evidence as the Governor in Council deems necessary.
