An Act to provide for the Office of High Commissioner for New Zealand in the United Kingdom.

BE IT ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—

1 Short Title.

The Short Title of this Act is “The High Commissioner Act, 1904.”

2 High Commissioner.

The Governor in Council may from time to time appoint some person to be the High Commissioner for New Zealand in the United Kingdom.

3 Term of office.

The High Commissioner shall hold office for such period not exceeding three years as is specified in the warrant of his appointment, and shall be eligible for reappointment; and such appointment shall be subject to good behaviour and to the conditions contained in section five hereof.

4 Exemption from Civil Service Regulations.

The High Commissioner shall not be subject to the laws in force in New Zealand relating to Civil servants.

5 Duties.

(1.)

The High Commissioner shall—

(a.)

Act as representative of New Zealand in the United Kingdom in lieu of the Agent-General, and as such representative shall exercise such powers and perform such duties as are conferred upon and assigned to him by the Governor.

(b.)

Carry out such instructions as he receives from the Government respecting the commercial, financial, and general interests of New Zealand in the United Kingdom and elsewhere.

(2.)

The High Commissioner shall not join the directorate or advisory board of any public company or trading corporation, whether registered or not.

6 Salary.

The salary of the High Commissioner shall be two thousand pounds a year, and shall be paid to him monthly out of the Consolidated Fund without further appropriation than this Act.

7 Travelling-allowance.

The High Commissioner when travelling on the public service of New Zealand shall be entitled to an allowance not exceeding one pound ten shillings for each day he is so engaged: Provided that no greater sum than two hundred and fifty pounds in the whole shall be paid or expended in respect of such allowance in any one financial year.

8 Statutory references to Agent-General.

On the first appointment of the High Commissioner the office of Agent-General shall be deemed to be abolished, and thereafter all references to the Agent-General in any Act in force shall be deemed to be references to the High Commissioner.

9 Appointment, &c., of officers.

(1.)

The Governor in Council may from time to time appoint such officers for the performance of clerical and other duties as may be required in the execution of this Act.

(2.)

The salaries of such officers shall be paid out of moneys to be appropriated by Parliament.

(3.)

Officers appointed under this Act shall not be subject to the laws in force in New Zealand relating to Civil servants.

(4.)

All appointments of officers under this Act shall be terminable by three months’ notice.

(5.)

No officer appointed under this Act shall be entitled to any compensation by reason of the loss of his office or of the diminution of his salary.

10 Regulations.

The Governor may from time to time by Order in Council make regulations for giving effect to this Act.
